August 19, 2013 (Regular Meeting) Page 1650 <br />00195675- 9356 -ARTS Ispecial Prog. supplies 1 $0.001 $2,000.001 $0.00 $2,000.00 <br />(G -8) ITS - Approval of Storage Area Network Lease Extension <br />ITS (Information Technology Services) requests approval of Storage Area <br />Network Lease Extension to increase storage capacity for Cabarrus County <br />Government, Cabarrus County Schools and Kannapolis City Schools. Funding was <br />approved in the FY 13 -14 budget. <br />UPON MOTION of Vice Chairman Measmer, seconded by Commissioner Burrage <br />and unanimously carried, the Board approved the lease agreement between <br />Cabarrus County and DDI Leasing, Inc.; and authorized the County Manager to <br />execute the contract on behalf of Cabarrus County, subject to review and /or <br />revision by the County Attorney. <br />(G -9) Planning and Development - Soil and Water Conservation Dist -rict - <br />Option to Purchase Conservation Easement Along Back Creep. <br />The Cabarrus Soil and Water Conservation District (CSWCD) and Mogensen <br />Mitigation Inc. (MMI) have an agreement whereby CSWCD will identify potential <br />sites for stream restoration and wetland mitigation projects, provide <br />technical assistance and hold conservation easements associated with <br />completed projects. On May 20, 2013, the Board of Commissioners approved the <br />agreement for a restoration project on Back Creek; following that approval, <br />MMI prepared an option to purchase a conservation easement as the next step <br />in this restoration project. This agreement went before the Board of <br />Education on June 10, 2013. <br />UPON MOTION of Vice Chairman Measmer, seconded by Commissioner Burrage <br />and unanimously carried, the Board approved the option to purchase the <br />conservation easement along Back Creek and adopted the Resolution Approving <br />Conveyance of Conservation Easement; Authorizing the Execution and Delivery <br />of Related Documents in Connection Therewith; and Providing for Certain Other <br />Related Matters. <br />Resolution No. 2013 -13 <br />RESOLUTION APPROVING CONVEYANCE OF CONSERVATION EASEMENT; AUTHORIZING THE <br />EXECUTION AND DELIVERY OF RELATED DOCUMENTS IN CONNECTION THEREWITH; AND <br />PROVIDING FOR CERTAIN OTHER RELATED MATTERS <br />WHEREAS, the County of Cabarrus, North Carolina (the "County ") is the <br />owner of that certain real property containing approximately [63.81] acres <br />and more specifically described in Deed Book [8757, page 315] of the Cabarrus <br />County Registry (the "Subject Property ") , which Subject Property is situated <br />near Hickory Ridge Middle School, Hickory Ridge High School and Hickory Ridge <br />Road. <br />WHEREAS, the Soil and Water Conservation District of Cabarrus County <br />( "SWCD ") has requested that the County grant a conservation easement over <br />approximately 1.5 acres of the Subject Property to Mogensen Mitigation, Inc., <br />a North Carolina corporation (the "Corporation ") , or its assigns, at a <br />purchase price of $1.00. <br />WHEREAS, the Board of Commissioners desires to approve the proposed <br />conveyance of the conservation easement and purchase price and to authorize <br />other actions in connection therewith; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners, as <br />follows: <br />Section 1. The conveyance of the conservation easement of <br />approximately 1.5 acres over the Subject Property to the Corporation, or its <br />assigns, for a purchase price of $1.00 is hereby approved. <br />Section 2. The Chairman or Vice Chairman of the Board of <br />Commissioners, the County Manager, any Deputy County Manager, the Finance <br />Director and the County Attorney are each hereby authorized to take any and <br />all such further action, including negotiation of any and all documents <br />related to the conveyance of the conservation easement and receipt of the <br />purchase price, and to execute and deliver for and on behalf of the County <br />all such documents and any other documents and certificates as they may deem <br />necessary or advisable to carry out the intent of this resolution and to <br />effect the conveyance of the conservation easement and receipt of the <br />purchase price. The Clerk to the Board of Commissioners is hereby authorized <br />to affix the seal of the County to such documents and certificates as may be <br />appropriate and to attest the same and to execute and deliver the same as may <br />be needed. <br />
