<br />Measmer: I am very concerned. My family has spent years, working hard, to
<br />secure a future for them and to secure a successful future for me. And
<br />that's something that I am not willing to just put on the line and be taken
<br />out from underneath me. You know, that is - that is a very serious past that
<br />has been dealt with me to make a decision on this.
<br />Small: What have you requested, Mr. Measmer that I haven't provided to you?
<br />Measmer: Well, as we were just discussing, was the reason for the denying of
<br />the first bond. I would like to have seen that information and you mentioned
<br />that Friday 5:00 p.m., we actually met that Thursday -
<br />Small: The information was given to me by Mr. Harris at 5:00 p.m. on Friday,
<br />Mr. Measmer.
<br />Measmer: Okay. Well, regardless, you know I'm not gonna argue with it, but
<br />you know we - you know we are put in a position and it scares me that, you
<br />know, that I'm personally liable and I know each person on this board would
<br />be very concerned about that. And considering what has went on, conspired in
<br />the past few weeks, we've been around and around and that throws a red flag.
<br />And it's, you know, we've never been faced with this issue before - any -
<br />anyone that works for the county - anyone that has to be bonded never had an
<br />issue. And you know, for me to say, well you know, to act on this is - I
<br />just can't do it.
<br />Small: You know honestly, I - I really - and this goes back to Ms. Poole's
<br />comment about being denied for a bond. Mr. Harris included a lot of his own
<br />personal information, made amendments to that bond application before it was
<br />sent in, I don't know what additional information was sent in. It doesn't
<br />matter, your sheriff still has a bond and my understanding is that you just
<br />paid out a 2 million dollar settlement for the negligence of the Sheriff's
<br />Office, I would think that would be a greater concern for the county than
<br />what we're talking about here today. I don't want to be personally liable
<br />either and I am personally liable, as an elected official of the register of
<br />deeds office. But I've been around and around because I'm the one who's done
<br />everything that I've been asked to do. I'm the one who's made the
<br />sacrifices. I'm the one who's had to pay out of pocket, without refund every
<br />time this county wants a different bond.
<br />Measmer: Right, and I certainly understand that -
<br />Small: I think with all due respect, I'm not sure you do Mr. Measmer -
<br />Measmer: I think each one of us have paid a lot out of pocket for the
<br />positions that we hold, regardless of what it is. So, you know, that just
<br />comes with the territory, your position of being the register of deeds -
<br />you're not going to be personally liable for anything that I do or anything
<br />that I could make a mistake on. So it's easy, you know, for anyone to say
<br />that yes, we should approve this, but whenever your personal assets are on
<br />the line, it's a whole different ball game.
<br />Small: Well, again, your personal assets are always on the line in this
<br />particular profession.
<br />Burrage: Well, I'm willing to stake everything I have, own, and ever worked
<br />for on Mr. Small -
<br />(Interruption from bystanders.)
<br />Burrage: You know there's a sayin' that the Christian army is the only army
<br />that shoots its wounded, and that's exactly what we're doing here today.
<br />We're taking a good man -
<br />(Interruption from bystanders.)
<br />Burrage: Now listen.
<br />Poole: Excuse me please.
<br />Burrage: Let me talk. You're taking a good man and you're taking away his
<br />rights, you're taking away the rights of every person that voted for that man
<br />and it's wrong - I don't how you look at it, I don't care who does it and I'm
<br />willing to set here right now and make the motion to pass this bond and put
<br />the man in office and quit this garbage.
<br />(Interruption from bystanders.)
<br />Poole: Excuse me. There is a motion on the table, is there a second to the
<br />motion?
<br />Burrage: No, there won't be one.
<br />Poole: If there is no second to the motion, the motion dies for lack of
<br />(inaudible). At this point, commissioners, are there any other comments or
<br />is there a motion to be made?
<br />White: I make a motion to deny the bond.
<br />Poole: At this point we have a motion on the table, is there a second to the
<br />motion on the table.
<br />Measmer: I second.
<br />Poole: There is a motion and there is a second, are there any discussion
<br />concerning the motion?
<br />Burrage: Yeah, it's wrong.
<br />Poole: There is no other discussion at this time commissioners we do have to
<br />make sure that the motion is - we need to make sure that the clerk of the
<br />court, I'm sorry not the clerk of court, the clerk to the board can properly
<br />record the motion because you know she is also required to be able to do
<br />that. So at this time those in favor of the motion please raise your right
<br />hand, all those in favor.
