December 19, 2012 (Recessed Meeting) Page 1368 <br />(Chairman Poole, Vice Chairman White, and Commissioners Morris and Measmer <br />raised their right hands in favor of the motion.) <br />Poole: All those opposed please show likewise. <br />(Commissioner Burrage raised his hand in opposition of the motion to deny the <br />bond.) <br />Poole: The motion passes four to one. Mr. Koch, <br />Koch: Yes, Madam Chair. <br />Poole: Can you explain where we are? <br />Burrage: Let me - let me ask a question. What's the purpose of us having a <br />party to vote people in and also what's the purpose of having an Executive <br />Committee with the Republican Party to pick somebody - ya'll set here and <br />said you were going to turn it over to the Republican Party to pick somebody. <br />They picked somebody and now you're sitting here a bunch of cowards and won't <br />even put the man in office. That don't make no sense to me. <br />(Interruption from bystanders.) <br />Poole: Excuse me, please. Mr. Koch? <br />Koch: Under NSGS 161 -5(al) as you are aware from before, when you declared <br />the office of register of deeds vacant on December 3r you notified the <br />Executive Committee of the Republican Party that the vacancy existed in that <br />office. And under that statute the party has 30 days from the occurrence of <br />the vacancy to - to recommend the person that the Board of Commissioners <br />shall appoint if they meet the other requirements for the office - that's <br />what the statute says. And so at this point, my reading of that statute is <br />that 30 days hasn't expired, the - you've made the decision to reject the <br />bond of Mr. Small this afternoon and there is still time left within that 30 <br />day period for the Republican Party Executive Committee to submit another <br />nominee. <br />Poole: And it's a 30 day period? <br />Koch: Yes. <br />Poole: So that started on December the 3rd? <br />Koch: Started on December 3 That was the date of the vote and the <br />notifications. <br />Poole: The 1" is a holiday, January 2na. <br />Koch: Well, thirty -one days in December, so it would be - the last day would <br />be - January 2nd. <br />Poole: January 2 Then, I have no idea what anybody's plans are for next, <br />between now and January 2 Is there anybody that's going to be out of town? <br />White: I'm going to be in and out. (inaudible) <br />(Multiple people speaking.) <br />Measmer: I'm leaving the 28 and I'll be out tit January the 7 - any time <br />before that. <br />Burrage: Well I won't be available to be any judge and jury on nobody. <br />Thank you. <br />White: When will you be back, Mr. Measmer? <br />Measmer: January 6th <br />White: And our meeting is January 2n - or January 7th <br />Measmer: Yes, that's correct. <br />(Multiple people speaking.) <br />Measmer: However, is the issue that this needs to be decided by the 31s? <br />Koch: I don't think that it needs to be decided by the 31 I think that the <br />30 day period is imposed upon the Party Executive Committee to submit a name. <br />After that then the right or power of appointment, if you will, is with the <br />Board of Commissioners. But then if a name is not submitted... <br />Measmer: I thought there was a concern about the current bonding at the <br />register of deeds office expiring the 31 <br />Koch: My understanding from Mr. Downs is that that's been taken care of. <br />Downs: My understanding - <br />Dubois: That bond has been extended until the (inaudible) or date of <br />termination. We will wait for a board decision. <br />(Multiple people speaking) <br />Poole: Okay. Mr. Lewis is telling me that they have a meeting scheduled for <br />tomorrow evening. So - sorry - (inaudible) during comments - but is it my <br />understanding that as long as we have a name by - before January 2n that's <br />what qualifies, correct? <br />Koch: That would be a name or nominee from the Republican Party Executive <br />Committee that you'd be required to appoint if they meet the other <br />requirements, yes. <br />Poole: Commissioner Measmer would not be available until January the 7 is <br />January the 7 as long as we have the name, we could adjourn this meeting <br />and meet on January the 7th <br />Koch: That is correct. Because I think the part that you may have missed <br />was the question about whether we have bonding that's been carried over from <br />Linda McAbee, extending up and to that date. And the answer is "yes ", it's <br />basically indefinite at this point until we notify the company otherwise. <br />Poole: Okay. <br />Measmer: Could we set up the meeting for the few days after Christmas? <br />Poole: Are you guys available on the 26 <br />Measmer: 26 or 27th <br />
