January 18, 2011 (Regular Meeting) Page 288 <br />WHEREAS, the North Carolina Division of Emergency Management has provided <br />assistance in the process of updating local hazard mitigation plans; and <br />WHEREAS, the Cabarrus County Emergency Management Department, the Cabarrus <br />County Commerce Department, and the Towns of Harrisburg, Midland and Mt. <br />Pleasant have worked together to complete a comprehensive review and <br />evaluation of each section of the previously adopted Hazard Mitigation Plan <br />and have updated the Plan as required by 44 CFR Part 201; and <br />WHEREAS, the draft plan has been reviewed and approved by the Federal <br />Emergency Management Agency, pending adoption by each of the local <br />governments involved. <br />NOW, THEREFORE, BE IT RESOLVED that the Cabarrus County Board of <br />Commissioners: <br />1. Reaffirms its commitment to local hazard mitigation planning as a logical <br />means of protecting people and property from the potential, devastating <br />effects of natural hazards. <br />2. Adopts the 2010 update of the Cabarrus County Multi - Jurisdictional Hazard <br />Mitigation Plan. <br />3. Agrees to take other official action as may be reasonably necessary to <br />carry out the objectives of the Hazard Mitigation Plan. <br />Adopted this 18th day of January, 2011. <br />/s/ H. Jay White, Sr., Chairman <br />Cabarrus County Board of Commissioners <br />Attest: <br />/s/ Kay Honeycutt <br />Kay Honeycutt, Clerk to the Board <br />(G -2) Commerce - Proposed Text Amendment - TEXT2010 -00005 and Public Hearing <br />- 6:30 P.M. <br />Susie Morris, Planning and Zoning Manager, presented a proposed Text <br />Amendment to the Cabarrus County Zoning Ordinance (No. TEXT2010- 00005) to add <br />tattoo studios as a permitted use in the GC (General Commercial) and LC <br />(Office /Limited Commercial) zoning districts and advised that a public <br />hearing is required. <br />Chairman White opened the public hearing at 6:51 p.m. The Public <br />Hearing Notice was published on January 5 and 12, 2011 in THE INDEPENDENT <br />TRIBUNE. The Public Hearing Notice was also posted on the County's website <br />( www.cabarrus county. us ) on January 4, 2011 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />Larry Marlowe, resident of 664 Odell School Road in Concord, asked to <br />have tattoo studios removed as a permitted use in the Odell community. <br />With there being no one else to address the Board, Chairman White <br />closed the public hearing. <br />At the request of the Board, Ms. Morris reported the applicable parcels <br />in the Odell community would require utility extension for development and <br />therefore would be annexed into Kannapolis and fall under their zoning <br />jurisdiction. She also clarified that home occupations of tattoo parlors is <br />not permitted. <br />Chairman White reported the use needs to be included somewhere in the <br />Zoning Ordinance now to prevent legal challenges. <br />Ms. Morris responded to additional questions from the Board and <br />discussion continued. <br />UPON MOTION of Vice Chairman Poole, seconded by Commissioner Carruth <br />and unanimously carried, the Board adopted the following ordinance: <br />Ordinance No. 2011 -02 <br />
