September 20, 2010 (Regular Meeting) Page 149 <br />Mr. Downs advised that CM Black has already conducted evaluations and <br />provided some preconstruction /pre- design services, but has not billed the <br />County yet. In response to questions from Commissioner Carruth, Mr. Downs <br />also addressed the responsibilities of a CM at Risk, including preparation of <br />bid packages, qualifying subcontractors, etc. He also addressed issues that <br />could arise if the project bid out by a general contractor. <br />After County Attorney Richard M. Koch addressed the main components of <br />the current contract with CM Black, he stated his preference to discuss the <br />legal aspects of the contract in closed session. <br />After a short discussion, Commissioner Carruth MOVED to retain the <br />professional services of Yates Chreitzberg Hughes Architects (YCH) for the <br />remodeling /renovation of the old Creamery building, the future site of the <br />Board of Elections and authorized the County Manager and County Attorney to <br />execute related documentation; and to table the selection of the <br />Contractor /Construction Manager at Risk to the October work session. <br />Mr. Downs confirmed that he, the County Attorney and the County Manager <br />are to renegotiate the contract with YCH for the new location (old Creamery <br />building). Afterwards, Chairman White advised that CM Black was selected for <br />originally because of their quality workmanship and the Board's desire to <br />employ as many locally -owned business and county residents as possible. <br />Vice Chairman Poole seconded the motion and the MOTION unanimously <br />carried. <br />(H) APPOINTMENTS <br />(H -1) Appointment - Animal Protection and Preservation Advisory Committee <br />(APPAC) <br />Commissioner Carruth stated at their September 1st meeting, the APPAC <br />voted to recommend the following citizens for appointment to the recently <br />expanded Committee: Marsha Hahn (Cabarrus CARES) to fill the unexpired term <br />of Patsy Beeker; Ann Cannon (Cabarrus Pets Society); Jeff Daniels (Justice <br />for Bella) ; Mike Sims (At Large) ; and Elizabeth Stamey (At Large) . He said <br />the Committee also recommends that the "Justice for Bella" (JFB) seat be <br />converted to an "at large" seat since JFB has not been formally organized. <br />Further, he stated there is one remaining seat to be filled that will be <br />addressed at the next meeting of the Committee on October 4 th <br />Commissioner Carruth MOVED to appoint Marsha Hahn (Cabarrus CARES) to <br />fill the unexpired term ending June 30, 2012; Ann Cannon (Cabarrus Pets <br />Society) for a one -year term ending June 30, 2011; Mike Sims (At- large) for a <br />one -year term ending June 30, 2011; Elizabeth Stamey (At- large) for a two - <br />year term ending June 30, 2012; and to convert the "Justice for Bella" seat <br />to an (At- large) seat and to appoint Jeff Daniels (At- large) for a two -year <br />term ending June 30, 2012. Vice Chairman Poole seconded the motion. <br />In response to Tamara Gaspar's comments during the Informal Comment <br />section of the meeting, Chairman White requested the Clerk to verify the <br />number of available seats on the APPAC. He also requested Ms. Gaspar to <br />provide information to the Clerk regarding the question she raised concerning <br />the number of seats on the APPAC. He advised Jo Henderson has contacted him <br />and expressed a strong desire to serve on the committee. <br />Commissioner Privette advised Mr. Daniels may not be able to serve if <br />convicted in Superior Court. <br />Richard Koch, County Attorney, advised if Mr. Daniels is convicted, it <br />will be for a misdemeanor and should not affect his ability to serve on the <br />committee. <br />Commissioner Privette MOVED to amend the previous motion to withhold <br />Jeff Daniels' appointment until the court decision is rendered. The motion <br />failed for lack of a second. <br />For clarification, Chairman White restated the original motion and <br />advised if there is a change in status that would exclude Mr. Daniels, the <br />Board would need to take the appropriate action at that time. <br />The MOTION carried, with Chairman White, Vice Chairman Poole and <br />Commissioners Carruth and Mynatt voting for and Commissioner Privette voting <br />against. <br />
