September 20, 2010 (Regular Meeting) <br />Page 112 <br />WHEREAS, Cabarrus County has negotiated with Habitat for Humanity <br />Cabarrus County, Inc., at no dollar cost, to convey the 30 acre tract <br />described above to Habitat for Humanity Cabarrus County, Inc. for development <br />of an affordable housing community. <br />THAT: <br />NOW, THEREFORE, THE BOARD OF COMMISSIONERS OF CABARRUS COUNTY RESOLVES <br />1. The County Manager is authorized to execute all documents necessary <br />to convey fee simple title to Habitat of Humanity Cabarrus County, Inc. of a <br />30 -acre tract of land between Warren C. Coleman Boulevard, Cabarrus Avenue <br />West and Brown Street in Concord, North Carolina (PIN #s 5620234056, <br />5620238271, 5620229833 and 5620211889). <br />2. The consideration for the conveyance is the following set of <br />conditions, covenants, and restrictions, which shall be incorporated in the <br />deed given by the County to Habitat for Humanity Cabarrus County, Inc: <br />a) The property shall only be used for development of an affordable <br />housing community consisting of only single family dwellings; and <br />b) Habitat for Humanity Cabarrus County, Inc., shall only convey <br />the property or any portion of the property to those individuals who have <br />been admitted into and successfully completed Habitat's home owner program. <br />3. The Clerk to the Board shall publish a notice summarizing the <br />contents of this resolution, and the property may be conveyed at any time <br />after 10 days after publication of the notice. <br />ADOPTED this the 20 day of September, 2010. <br />CABARRUS COUNTY BOARD OF COMMISSIONERS <br />By: /s/ H. It is recommended to piggyback the Durham <br />County bid awarded in November 2009 to RDS, Canton, NC, pursuant to North <br />Carolina G.S. 143 -129. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole <br />and unanimously carried, the Board approved the Piggyback bid award (RDS, <br />Canton, NC, November 2009 for $139,973.84) and authorized the County Manager <br />to execute the contract between Cabarrus County and RDS, subject to revision <br />by the County Attorney. <br />(F -4) County Manager - Approval of Access / Utility Easement Agreement with <br />Town of Harrisburg for Hickory Ridge Middle School <br />The Town of Harrisburg is providing water, storm water and sewer <br />services to the School. In order to do this effectively and not to incur any <br />undo liabilities, the Town has requested a permanent access and utility <br />easement agreement. This agreement will grant the Town the right to gain <br />access to areas on the school site that contain utility lines and ponds for <br />the purposes of routine inspection and any required maintenance deemed <br />necessary by the Town to ensure continuous service to the school. <br />The County currently holds title to the Hickory Ridge Middle School <br />property for financing purposes. The County Attorney has already reviewed <br />and approved the document in its current form. <br />
