<br />(F -11) Fire Marshal's Office - Adopt a Resolution Permitting Pyrotechnics
<br />Displays
<br />This past year the State Fire Marshal's Office, through numerous
<br />training events, has brought to light that most city jurisdictions are in
<br />violation of general statutes and are issuing permits for pyrotechnic shows
<br />without delegation of authority from the county. NCGS §14- 413(al) allows the
<br />County Board of Commissioners to grant authority to municipalities to issue
<br />permits for pyrotechnic displays within their corporate limits. The Cabarrus
<br />County Fire Marshal asks that authority be granted to: City of Kannapolis
<br />(only within Cabarrus County), City of Concord, and Town of Harrisburg. The
<br />following resolution grants that authority.
<br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Poole
<br />and unanimously carried, the Board adopted the following resolution:
<br />Resolution No. 2010 -24
<br />RESOLUTION DELEGATING AUTHORITY TO CERTAIN MUNICIPAL GOVERNING BODIES
<br />TO APPROVE ISSUING PERMITS FOR PYROTECHNICS
<br />WHEREAS, in accordance with NCGS §14- 413(a), the Cabarrus County Board
<br />of Commissioners must approve the use of pyrotechnics in Cabarrus County; and
<br />WHEREAS, NCGS §14- 413(al) allows the Board of Commissioners to
<br />authorize the governing body of any city in the County to issue permits for
<br />pyrotechnics to be exhibited, used or discharged within the corporate limits
<br />of such city.
<br />THEREFORE, BE IT RESOLVED, that the Cabarrus County Board of
<br />Commissioners does hereby delegate to the governing bodies of the City of
<br />Kannapolis (in Cabarrus County only), the City of Concord, and the Town of
<br />Harrisburg, the County's authority to issue permits for pyrotechnics to be
<br />exhibited, used, or discharged within the corporate limits of each such city,
<br />pursuant to the provisions of NCGS 14 -413 (al) and (b).
<br />BE IT FURTHER RESOLVED, that the Cabarrus County Fire Marshal is still
<br />authorized to determine the issuance of permits for pyrotechnics to be
<br />exhibited, used or discharged inside all other municipal jurisdictions within
<br />Cabarrus County and in the unincorporated areas of the County.
<br />BE IT FURTHER RESOLVED, that this resolution shall remain in effect
<br />until modified or rescinded by the Cabarrus County Board of Commissioners.
<br />Nothing in this resolution shall be deemed to expand the authority of any
<br />city within the County to issue permits beyond that authority granted in NCGS
<br />§14 -413 or the North Carolina Fire Code.
