<br />Piedmont Area Mental Health, Developmental Disabilities and Substance Abuse
<br />Authority to "PBH".
<br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth
<br />and unanimously carried, the Board adopted the following resolution:
<br />Resolution No. 2009-07
<br />JOINT RESOLUTION
<br />OF THE BOARDS OF COUNTY COMMISSIONERS
<br />OF CABARRUS COUNTY, DAVIDSON COUNTY, ROWAN COUNTY,
<br />STANLY COUNTY AND UNION COUNTY
<br />WHEREAS, the Board of County Commissioners of Cabarrus County, the
<br />Board of County Commissioners of Stanly County, and the Board of County
<br />Commissioners of Union County by Joint Resolution dated April 1, 1979,
<br />established Piedmont Area Mental Health Program; and
<br />WHEREAS, the Board of County Commissioners of Cabarrus County, the
<br />Board of County Commissioners of Stanly County, and the Board of County
<br />Commissioners of Union County by Joint Resolution dated March 31, 1981,
<br />modified their Joint Resolution dated April 1, 1974, by naming the entity
<br />"Piedmont Area Mental Health, Mental Retardation, and Substance Abuse
<br />Authority; and
<br />WHEREAS, by Joint Resolution dated October 1, 1997, the County
<br />Commissioners of Cabarrus, Rowan, Stanly and Union Counties included Rowan
<br />County as a participating county in the area authority and renamed it
<br />Piedmont Area Mental Health, Developmental Disabilities and Substance Abuse
<br />Authority: and;
<br />WHEREAS, by Joint Resolution adopted by the Boards of Commissioners of
<br />Cabarrus County (on April 21, 2003), Davidson County (on May 13, 2003), Rowan
<br />County (on March 17, 2003), Stanly County (on May 5, 2003) and Union County
<br />(on April 7, 2003), providing that Davidson County, pursuant to G.S. 122C-115
<br />(c) became a participating county in the multi-county Area Authority known as
<br />Piedmont Area Mental Health, Developmental Disabilities and Substance Abuse
<br />Authority, and
<br />WHEREAS, for many years, Piedmont Area Mental Health, Developmental
<br />Disabilities and Substance Abuse Authority has for several years operated
<br />under the name "Piedmont Behavioral Healthcare", the acronym for which is
<br />"PBH", and
<br />WHEREAS, by Session Law 2001-437 effective July 1, 2002, entitled "An
<br />Act to Phase In Implementation of Mental Health System Reform at the State
<br />and Local Level," the North Carolina General Assembly has amended North
<br />Carolina General Statute Chapter 122C and launched extensive changes in North
<br />Carolina's mental health system, and,
<br />WHEREAS, Piedmont Area Mental Health, Developmental Disabilities and
<br />Substance Abuse Authority has been recognized as a state leader in
<br />implementing mental health system reform and has now successfully made the
<br />transition to the status of Local Management Entity or "LME", as defined by
<br />G.S. 122C-3 (20b) carrying out the functions of an LME as set forth in G.S
<br />122C-115.4, and
<br />WHEREAS, Piedmont Area Mental Health, Developmental Disabilities and
<br />Substance Abuse Authority desires to manifest its change in status to an LME
<br />with a formal change of its name to PBH, and
<br />WHEREAS, Piedmont Area Mental Health, Developmental Disabilities and
<br />Substance Abuse Authority has obtained U.S. Servicemark Registration No.
<br />3,150,979 dated October 3, 2006, for "PBH",
<br />WHEREAS, the parties to this agreement believe that it is in the best
<br />interests of all concerned to re-name Piedmont Area Mental Health,
<br />Developmental Disabilities and Substance Abuse Authority with the new name
<br />PBH,
<br />NOW, THEREFORE, BE IT RESOLVED JOINTLY BY THE BOARDS OF COUNTY
<br />COMMISSIONERS OF CABARRUS COUNTY, DAVIDSON COUNTY, ROWAN COUNTY, STANLY
<br />COUNTY, AND UNION COUNTY that the Joint Resolution of the Boards of County
<br />Commissioners of Cabarrus, Stanly, and Union Counties dated April 1, 1979, as
<br />amended by the Joint Resolution of the Boards of County Commissioners of
<br />Cabarrus, Stanly and Union Counties dated March 31, 1981, as further amended
