June 1, 2009 (Work Session) <br />Page 1425 <br />UPON MOTION of Vice Chairman Mynatt, seconded by Commissioner Poole and <br />unanimously carried, the Board voted to place the proposed Text Amendment <br />C2009-02-ZT to Chapter 10, Parking and Loading, Cabarrus County Zoning <br />Ordinance on the June 15, 2009 Agenda as a New Business item and scheduled a <br />public hearing for 6:30 p.m. <br />Commerce - Consent Agreement Extension for The Village at Dreamin Creek <br />Subdivision <br />Susie Morris, Planning and Zoning Manager, presented the following <br />information regarding a Consent Agreement extension for The Village at <br />Dreaming Creek: <br />The Village at Dreaming Creek subdivision project was <br />approved by the City of Concord Planning and Zoning Board on July <br />17, 2007. The preliminary plat was granted a two year extension <br />on April 21, 2009 setting a new expiration date of July 17, 2011. <br />This subdivision project is approved for 57 single family homes <br />and 96 multi-family units on +/- 31.77 acres and is located at <br />the intersection of NC Highway 29 and Concord Farms Road. <br />The Cabarrus County Board of Commissioners previously <br />approved a Consent Agreement for this subdivision development on <br />August 20, 2007. The existing Consent Agreement is set to expire <br />on July 17, 2009. The developer is seeking a two-year extension <br />of the existing agreement. The specifics of the existing <br />agreement are as follows: <br />• Developer -Yates Properties, LLC, 195 Union Street S., <br />Concord, NC 28025. <br />• Payment of $9, 039 per single family lot will be due prior <br />to Final Platting. <br />• Payment of $l, 331 per multi-family unit will be due prior <br />to Final Platting. <br />• The current approved build out schedule is calendar year <br />2007, no more than 29 single family lots platted and no more than <br />28 multi-family building permits issued; calendar year 2008, no <br />more than 28 single family lots platted and no more than 18 <br />multi-family building permits issued. <br />The developer is proposing the following modifications of the <br />build out schedule. <br />• Proposed build out schedule is calendar year 2010, no more <br />than 29 single family lots platted and no more than 28 multi- <br />family building permits issued; calendar year 2011, no more than <br />28 single family lots platted and no more than 18 multi-family <br />building permits issued. <br />The APFO worksheet filled out by Mr. Robert Kluttz with <br />Cabarrus County Schools indicates that schools impacted by The <br />Village Dreaming Creek subdivision project are currently <br />functioning at the following capacities: <br />Note: These percentages are based on the enrollment figures from <br />March 6, 2009. <br />Wolf Meadow Elementary School - 119.23 <br />J.N. Fries Middle School - 108.33 <br />Jay M. Robinson High School - 99.01 <br />Including previously approved subdivisions, these schools <br />will be functioning at the following capacity upon completion of <br />The Village at Dreaming Creek subdivision project: <br />Wolf Meadow Elementary School -131.065 ~ <br />J.N. Fries Middle School - 127.72 <br />Jay M. Robinson High School - 110.46% <br />There are no improvements scheduled over the next five <br />years that would provide relief for Wolf Meadow Elementary <br />School. <br />
