The County Manager may award and execute contracts which are not <br />required to be bid or which G.S. 193-131 allows to be let on <br />informal bids so long as the annual budget or appropriate <br />capital project ordinance contains sufficient appropriated but <br />unencumbered funds for such purposes. <br />12. The County Manager may execute contracts with outside agencies <br />to properly document budgeted appropriations to such agencies <br />where G.S. 153 A-248(b), 259, 999 and any similar statutes <br />require such contracts. <br />13. The County Manager may reject formal bids when deemed <br />appropriate and in the best interest of Cabarrus County pursuant <br />to G.S. 143-129(a). <br />C. Changes to Cabarrus County fees and charges as presented in <br />budget workshops will be effective July 1, 2009 and incorporated <br />into the appropriate fee schedules. <br />Section III. <br />This ordinance and the budget documents shall be the basis of the <br />financial plan for the County of Cabarrus for the 2009-2010 fiscal <br />year. The County Manager and the Budget Officer shall administer the <br />budget. The Finance Director shall establish and maintain all records, <br />which are in concurrence with this budget and budget ordinance and the <br />appropriate statutes of the State of North Carolina. <br />Adopted this the 15th day of June, 2009. <br />/s/ H. He stated the County was able to <br />cut expenses by approximately $15.9 million. He expressed his confidence in <br />the leadership shown by the County school systems during the budget process <br />and expressed appreciation for everyone's patience. <br />Commissioner Carruth pointed out that only twenty percent of the budget <br />is discretionary spending; the other eighty percent is mandated. He thanked <br />staff for their hard work and noted the need to proceed with school <br />construction. <br />(G-2) Sheriff's Department - Permits for Sound Amplification - Amend Chapter <br />30, Section 30-28 of the Cabarrus County Code of Ordinances <br />Captain Phillip Patterson, Cabarrus County Sheriff's Department, <br />presented a proposed amendment to Chapter 30, Noise, Section 30-28 of the <br />Cabarrus County Codeof Ordinances, which will add additional requirements to <br />the application process for permits for sound amplification. He addressed <br />the following issues; citizens of the County can apply to utilize a sound <br />amplification system within the County for outdoor parties; citizens may <br />apply for a permit; the amendment to the ordinance will require the applicant <br />to notify adjacent neighbors within 500 feet of the date, time, and duration <br />of an event; etc. <br />In response to numerous questions from the Board, Captain Patterson <br />addressed the following: citizens who violate the noise ordinance can be <br />cited; applicants may use the County Geographic Information Systems (GIS) <br />system to determine which neighbors must be notified; applicants for the <br />permit will be required to sign an affidavit in the presence of the Sheriff; <br />without proper notification, a permit would be null and void; sound <br />amplification that may penetrate the residences of neighbors may be in <br />violation; etc. <br />Chairman White opened the public hearing at 6:57 p.m. The Public <br />Hearing Notice was published on June 7, 2009 in THE INDEPENDENT TRIBUNE. The <br />notice was also posted on the County's website on June 2, 2009. <br />
