June 15, 2009 (Regular Meeting) Page 1458 <br />There was no one present to address the Board; therefore, Chairman <br />White closed the public hearing. <br />UPON MOTION of Commissioner Privette, seconded by Vice Chairman Mynatt, <br />and unanimously carried, the Board adopted the following ordinance: <br />Ordinance No. 2009-10 <br />AN ORDINANCE AMENDING CABARRUS COUNTY'S CODE OF ORDINANCES <br />CHAPTER 30, ENVIRONMENT <br />ARTICLE II. NOISE <br />SECTION 30-28 (a), APPLICATION <br />Be it ordained that Chapter 30, Article II, Section 30-28 (a) of the <br />Cabarrus County Code of Ordinances is hereby amended to include the following <br />underlined text: <br />Sec. 30-28. Permits for sound amplification. <br />(a) Application. The application for a permit for sound amplification under <br />section 30-27 may be obtained from the sheriff's department or the clerk <br />to the board of county commissioners. Completed applications shall be <br />submitted to the sheriff's department at least 15 working days in advance <br />of the planned use except in case of emergency. The applicant for a <br />permit shall be responsible for sending a notice by certified and regular <br />mail or by otherwise delivering the notice to the owners or occupants of <br />each property within five hundred (500) feet of the parcel of real estate <br />for which a permit has been applied. The notice shall state the type of <br />event and date and hours of the event. The notice shall be sent on a form <br />approved by the sheriff's office and shall be delivered at least seventy <br />two (72) hours in advance of the event. The permit shall not be granted <br />and issued until the applicant submits an affidavit satisfactory to the <br />sheriff's office that such notices have actually been mailed or otherwise <br />delivered. The applicant must attach to the affidavit a listing of the <br />names of the owners or occupants and the street addresses of the <br />to this section. <br />Adopted this the 15`" day of June, 2009. <br />/s/ H. Ms. Morris reported the <br />following: the proposed amendment will allow additional materials to be used <br />for parking lots; the amendment allows flexibility with paving and exceptions <br />if parking is considered overflow; the amendment includes no backing <br />movements into thruways to avoid conflicting traffic patterns; the text <br />amendment was posted on the County website on June 2"d and has been viewed by <br />thirty-one people and twenty-seven of those people linked to read the text of <br />the amendment; and no feedback or calls were received from those who viewed <br />the amendment text. <br />Chairman White opened the public hearing at 6:59 p.m. The Public <br />Hearing Notice was published on May 27 and June 3, 2009 in THE INDEPENDENT <br />TRIBUNE.
