UPON MOTION of Commissioner Privette, seconded by Vice Chairman Mynatt, and unanimously carried, the Board adopted the following ordinance: Ordinance No. 2009-10 AN ORDINANCE AMENDING CABARRUS COUNTY'S CODE OF ORDINANCES CHAPTER 30, ENVIRONMENT ARTICLE II. NOISE SECTION 30-28 (a), APPLICATION Be it ordained that Chapter 30, Article II, Section 30-28 (a) of the Cabarrus County Code of Ordinances is hereby amended to include the following underlined text: Sec. 30-28. Permits for sound amplification. (a) Application. The application for a permit for sound amplification under section 30-27 may be obtained from the sheriff's department or the clerk to the board of county commissioners. Completed applications shall be submitted to the sheriff's department at least 15 working days in advance of the planned use except in case of emergency. The applicant for a permit shall be responsible for sending a notice by certified and regular mail or by otherwise delivering the notice to the owners or occupants of each property within five hundred (500) feet of the parcel of real estate for which a permit has been applied. The notice shall state the type of event and date and hours of the event. The notice shall be sent on a form approved by the sheriff's office and shall be delivered at least seventy two (72) hours in advance of the event. The permit shall not be granted and issued until the applicant submits an affidavit satisfactory to the sheriff's office that such notices have actually been mailed or otherwise delivered. Susie Morris, Planning and Zoning Manager, presented information related to a proposed Text Amendment C2009-02-ZT to Chapter 10, Parking and Loading, Cabarrus County Zoning Ordinance. Ms. Morris reported the following: the proposed amendment will allow additional materials to be used for parking lots; the amendment allows flexibility with paving and exceptions if parking is considered overflow; the amendment includes no backing movements into thruways to avoid conflicting traffic patterns; the text amendment was posted on the County website on June 2"d and has been viewed by thirty-one people and twenty-seven of those people linked to read the text of the amendment; and no feedback or calls were received from those who viewed the amendment text. Chairman White opened the public hearing at 6:59 p.m. The Public Hearing Notice was published on May 27 and June 3, 2009 in THE INDEPENDENT TRIBUNE.
