September 21, 2009 (Regular Meeting) Page 1619 <br />(F-6) Human Resources - Drug Free Workplace Policy Revision <br />This is a proposed revision to the current Drug Free Workplace Policy <br />which was enacted by the Board of County Commissioners in April 2009. The <br />proposed revision adds a Release of Information Form - 99 CFR Part 90.25 Drug <br />and Alcohol Testing Records as Form F to the Drug Free Workplace Policy. <br />This form was developed to gather required information as explained in <br />the Drug Free Workplace Policy, Section V.C.: Applicants and all current <br />employees who apply for assignment, transfer, or promotion to a DOT regulated <br />position must sign an Authorization for Release of Personal Information Form <br />for the release of alcohol and drug testing data compiled by previous <br />employers covered by 49 CFR Part 90 and provide the County information about <br />drug and alcohol violations. Departments that have DOT regulated positions <br />will contact Human Resources for guidance in obtaining this information. <br />UPON MOTION of Commissioner Carrut h, seconded by Commissioner Poole and <br />unanimously carried, the Board voted to include the Release of Information <br />Form - 49 CFR Part 40.25 Drug and Alcohol Testing Records as Form F of the <br />Drug Free Workplace Policy. <br />(F-7) Human Resources - Substantial Equivalency Petition Resolution <br />North Carolina General Statute ~ 126-11 allows the board of county <br />commissioners to petition the State Personnel Commission for approval of the <br />local personnel system as substantially equivalent to the standards <br />established under NCGS Chapter 126 for local county employees of the <br />department of social services and certain emergency management programs. If <br />approved by the State Personnel Commission, the Cabarrus County employees of <br />the department of social services and certain emergency management programs <br />will be exempt from Chapter 126 for the approved portions of the county <br />personnel system. The proposed resolution provides the petition from <br />Cabarrus County to the State Personnel Commission to determine if the <br />Cabarrus County personnel system meets the requirements for substantial <br />equivalency. <br />UPON MOTION of Commissioner Carrut h, seconded by Commissioner Poole and <br />unanimously carried, the Board adopted the following resolution: <br />Resolution No. 2009-23 <br />RESOLUTION <br />SEEKING APPROVAL FROM THE NORTH CAROLINA STATE PERSONNEL COMMISSION THAT <br />CABARRUS COUNTY HAS A PERSONNEL SYSTEM SUBSTANTIALLY EQUIVALENT TO THE <br />STANDARDS ESTABLISHED UNDER NORTH CAROLINA GENERAL STATUTE CHAPTER 126 <br />WHEREAS, North Carolina General Statute ~ 126-11 authorizes counties to <br />establish local personnel systems; and <br />WHEREAS, the Cabarrus County Board of County Commissioners may petition <br />the State Personnel Commission to determine whether any portion of its total <br />personnel system meets the requirements of Chapter 126, the State Personnel <br />System, of the North Carolina General Statutes; and <br />WHEREAS, said county personnel system and any substantial changes to <br />the system, shall be approved by the State Personnel Commission as <br />substantially equivalent to the standards established under Chapter 126 for <br />employees of local departments of social services, local health departments, <br />area mental health programs, and local emergency management programs; and <br />WHEREAS, the staff and resources are available to Cabarrus County to <br />maintain a qualified personnel system; and <br />WHEREAS, Cabarrus county seeks a determination of substantial <br />equivalency for all or a portion of the system; and <br />WHEREAS, upon such determination, county employees shall be exempt from <br />the provisions of Chapter 126 relating to the approved portions of the county <br />personnel system; and <br />NOW THEREFORE, BE IT RESOLVED, that the Cabarrus County Board of County <br />Commissioners approves and supports this petition from Cabarrus County to the <br />State Personnel Commission to determine if the Cabarrus County personnel <br />
