October 5, 2009 (Work Session) <br />Page 1646 <br />He specified, as required by the enabling legislation, a public hearing <br />by the local advisory board must be held in order to condemn a property in a <br />Voluntary Agricultural District. As such, NCDOT has requested the public <br />hearing which is scheduled for October 13, 2009. He acknowledged the Board <br />may want to consider going on the record with its position, but he thought it <br />would be important for the matter to be discussed after the Advisory board <br />has had its meeting so information can be presented to the Board. <br />Commissioner Carruth questioned why the majority seem to agree with <br />Option No. 2 as the better choice, but NCDOT has chosen to proceed with <br />Option No. 1. Mr. Day responded because the route is straighter, less <br />expensive, and less disruptive. Chairman White noted, although not shown on <br />the handout, on the curve of option B, a good portion is going to be four- <br />laned. He noted at present the entire route of Pitts School Road is two- <br />laned. He also noted Poplar Tent is opposed to the realignment because he <br />presumes it will take away some of their entrances and exits, and would also <br />create a right-in/right-out on Poplar Tent to the church which would avoid <br />left hand turns out of the church. He advised the plans were not created by <br />the County, they are the only options available and that the County is <br />contemplating the best way to support the plan that will assist the most <br />people. <br />In response to Commissioner Frivette's inquiry of the location of Ralph <br />Bond's property, Mr. Day identified where the Bonds property is located and <br />illustrated the area not in the Voluntary Agricultural District which is <br />where the road realignment will be routed. <br />Commissioner Carruth questioned whether consideration is given in <br />Option No. 1 mainly because of transportation back and forth between the <br />sides of the property of any tunnels under the road to allow access on one <br />side of the farm to the other. Mr. Day stressed the road and the right-of- <br />way would take a significant portion of land out of production. <br />In response to questions regarding the October 13`" Advisory board <br />meeting, Mr. Day advised the advisory board must schedule a public hearing in <br />10 days after receiving a request. Commissioner Poole sought clarification <br />when the item needed to be put on the agenda for the Board's statement. Mr. <br />Day noted if the Board wanted to continue the matter and make a final <br />decision at the next meeting, he would provide the Board with information <br />produced at the hearing. He surmised the public comment portion ended <br />sometime in October but will provide the Board with a definite date. <br />Chairman White .advised if the item is placed on the October 19, 2009 <br />agenda for the Board to consider a resolution, the Board needs to look at the <br />option that will have the least impact on the Barbee and Bond properties. He <br />stated the property owners preferred Option No. 2 which would have the least <br />affect on the property owners and their employees. He noted, to the <br />contrary, Option No. 1 would adversely affect the property owners. <br />Commissioner Poole requested clarification that the idea would be to <br />get information from the Advisory board's meeting then by the October 19, <br />2009 meeting the Board would have a couple of days to contemplate their <br />preference to draft a resolution. <br />
