He said there <br />would be capacity at the middle and high school levels. <br />Mark McCormick said he checked with Ms. Kassie Goodson Watts, County <br />Planner, that there would be capacity before he closed on the property last <br />Thursday, April 3, 2008. He said he became very concerned when he saw the <br />figure of $9, 100 for each unit and was not anticipating that. He asked if <br />the mitigation payment would remain the same since there was not capacity <br />only at the elementary school level. <br />Mr. Koch explained that the Ordinance provides that as long as there is <br />not capacity at any level, the entire mitigation payment will apply. <br />Mr. Cary Gluff, Designer for <br />talked to the school system about c <br />was at 102 or 109 percent capacity, <br />until 110 percent. He said that is <br />over capacity and 68 students, <br />elementary school over 110 percent. <br />Mardan X Apartment project, said when he <br />apacity, he was told the elementary school <br />but is not considered to be over capacity <br />why they thought none of the schools were <br />mostly elementary, would not put the <br />Chairman White suggested the item be placed on the Agenda as a New <br />Business item to allow everyone time to get their questions addressed. <br />Mr. Gluff read an excerpt from Chapter 15, Section 7, Subsection 1 of <br />the Adequate Public Facilities Ordinance, and said his questions pertained to <br />this section of the Ordinance. <br />Mr. Day stated Ms. Morris will be happy to review the Ordinance with <br />you because there are other references that are applicable as well. <br />Ms. Morris reported information from the school system shows the <br />elementary school at 118.56 percent capacity. <br />Chairman White asked Ms. Morris to verify the numbers. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Mynatt and <br />unanimously carried, the Board voted to place the Reservation of Capacity <br />Certificate for the Mardan X, LLC Apartment Subdivision Project on the April <br />21, 2008 Agenda as a New Business item. <br />Reservation of Capacity Certifiaate - Meadow Creek Apartments <br />Susie Morris, Planning and Zoning Manager, presented the following <br />information related to the Reservation of Capacity Certificate for the Meadow <br />Creek Apartment Project: <br />GHI of West Palm Beach, LLC (10312 Annie Oakley Trail, Charlotte, <br />NC 28227) requests a reservation of capacity for the Meadow Creek <br />Apartments Project, which consists of 1 multi-family residential <br />building with 14 apartment units on +/- 9.717 acres located at <br />the intersection of Easy Street and Highland Street in the City <br />of Kannapolis. This is an additional phase of an existing multi- <br />family project. <br />School Capacity Review <br />Meadow Creek Apartments will produce 4 students. The schools <br />impacted by the project are Winecoff Elementary School, Northwest <br />Cabarrus Middle.School and Northwest Cabarrus High School. <br />Cox Mi11 High School, which is under construction, is projected <br />to open in 2010 in the western part of Cabarrus County. This <br />school will relieve Northwest Cabarrus and Jay M. Robinson High <br />Schools. <br />The County's Capital Improvements Plan (CIP) includes <br />construction of a new middle school in 2010 in the south central <br />part of the County that would relieve Northwest Cabarrus Middle <br />School, Harris Road Middle School and J.N.
