April 7, 2008 (Work Session) Page 782 <br />2008 35 <br />2009 35 <br />2010 35 <br />2011 35 <br />2012 8 <br />Mr. Wayne said he wants to make certain the Board understands that he <br />is not saying that he does not intend to develop the previously approved <br />lots, but that he is merely agreeing to a schedule to limit the development <br />of the lots that do not require a consent agreement because they are already <br />approved. He said he could begin developing the 103 previously approved lots <br />immediately; the 95 additional lots are part of a 100-acre tract that is <br />adjacent to the same project; and he could geographically develop these lots <br />more prudently at this time. He clarified that he is asking for approval of <br />the Reservation of Capacity with an accelerated pace from what the County <br />staff has recommended by borrowing some of the available lots in the other <br />phases that have been approved through preliminary plat; and that he agrees <br />to limit development to a total of 35 units for the years of 2008, 2009, <br />2010, 2011 with 8 lots in 2012. <br />Mr. Wayne also responded to questions from the Board. He pointed out <br />by developing the new lots first, the voluntary mitigation payment would be <br />paid sooner thereby improving the County's cash flow. <br />Mr. Day pointed out that there are no phasing or mitigation <br />requirements on the previously approved lots. <br />Mr. Wayne stated that he could begin construction tomorrow on a 103 <br />units that are already approved, but is agreeing not to; and, to go at a <br />reasonable rate of 35 units per year, balanced at their discretion, between <br />the new approval (95 lots) and the old approval (1.03 lots) to_whatever extent <br />makes economic sense to them to develop in the most rational way they can <br />market the property. He said all the lots in Park Creek are single family <br />units on large lots and the density in the next phase (95 lots) is very low. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board voted to place the revised Reservation of <br />Capacity Certificate for the Park Creek Subdivision Project on the April 21, <br />2008 Agenda as a New Business item. <br />Reservation of Capacity Certificate - Villas at Forest Park Apartment Project <br />Susie Morris, Planning and Zoning Manager, presented the following <br />information related to the Reservation of Capacity Certificate for the Villas <br />at Forest Park Apartment Project: <br />Douglas Company, LLC., (709 North Main Street, Aynor, SC 29511) <br />is requesting a reservation of capacity for the Villas at Forest <br />Park apartment project, which consists of 69 multi-family <br />residential units on +/- 10.018 acres located on Little Texas <br />Road in Kannapolis, North Carolina. <br />School Capacity Review <br />The Villas at Forest Park apartment project will produce 18 <br />students. The schools impacted by the project are Forest Park <br />Elementary School, Kannapolis Intermediate School, Kannapolis <br />Middle School and A.L. Brown High School. <br />The County's Capital Improvements Plan (CIP) includes <br />construction of a new wing at A.L. Brown High School that will <br />add 500 seats.
