May 5, 2008 (Work Session) Page 817 <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board voted to place Cabarrus County Fire <br />Marshal's Office recommended boundary changes on the June 16, 2008 Agenda as <br />a New Business item, including a public hearing at 6:30 p.m. <br />Concord Utility Right-of-Way Request - Old Fairgrounds Property <br />Mike Downs, Deputy County Manager, presented a request from the City of <br />Concord for a 50' electrical utility right-of-way, extending from Union <br />Cemetery Road through the County's property (Old Fairgrounds) to Highway 601 <br />South. In exchange for this right-of-way, the City proposes to perform the <br />on-site demolition work that will be needed to construct the proposed School <br />Bus Maintenance Facility and the new County satellite facility. <br />Bob Pate, City of Concord Supervisor of Electrical Overhead Operations, <br />reviewed the following proposal from the City to provide the demolition work <br />in lieu of a cash payment: <br />From: Alex Burris [BurrisA@ci.concord.nc.us] <br />Sent: Monday, April 28, 2008 2:15 PM <br />To: Mike Downs <br />Cc: Bob Pate; Dennis Roberts; Bill Seamone <br />Subject: New Bus Garage ROW <br />Mike, <br />Per our conversation, this is a formal request for 50' of ROW <br />adjacent to Duke Power and City of Concord existing ROW across <br />this property, as shown on the map you were provided in the <br />meeting here at the Brown Center. We propose in return for the <br />50' ROW, demolition/removal of all poles and related materials <br />will be removed at no cost. Included in this proposal will be the <br />relocation of a pole along Union Cemetery Rd for the new <br />entrance. We will also have to install two anchors/guys on the <br />County side of this project, not related to the bus garage site. <br />In this proposal we agree to remove 12 poles per the bus garage <br />plans. However, at this time we would like to propose to remove <br />all poles and equipment on this site to prepare for future County <br />expansion. By removing all poles we would remove 12 poles for the <br />bus garage and another 18 poles for the future development. <br />As requested by the County, we will remove all existing County <br />owned flood lights and all county owned, pole mounted breaker <br />panels. It would be our suggestion to have a representative from <br />the County present during this demolition to reclaim the lights <br />and breaker panels. <br />We are still working on a cost for the demolition and hope to <br />have that to you in the next couple of days. <br />If you have any questions or concerns please feel free to contact <br />myself or Bob Pate. <br />Alex Burris <br />Electrical Engineering Technician <br />City of Concord Electrical Systems <br />Mr. Downs mentioned there is more planning to be done and that several <br />light poles may need to be removed for the right-of-way. He said this <br />proposal, which cuts across school property, may require the installation of <br />a minimum of one light pole, hopefully in one of the existing islands, and <br />that one parking space may be lost. He also mentioned that the proposal has <br />been discussed with and agreed upon by Sam Masters, Cabarrus County Schools. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Mynatt and <br />unanimously carried, the Board voted to place the Concord Utility Right-of- <br />Way Request on the May 19, 2008 Agenda as a Consent item. <br />Reservation of Capacity Certificate - Villas at Forest Park Apartment Project <br />Richard Koch, County Attorney, presented an update on the status of the <br />discrimination and enforceability issues associated with the Villas at Forest <br />Park Apartment project for elderly residents. In summary, he reported that <br />additional information was recently received from the developer concerning <br />the Fair Housing Act. He suggested the item be placed on the Agenda as a New <br />
