September 8, 2008 (Work Session) Page 954 <br />required tools and equipment; the inclusion of maintenance contracts for the <br />HVAC and boiler; and salaries. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Juba and <br />unanimously carried, the Board voted to place approval of proposal/contract <br />with Keith and Keith Company for maintenance and custodial services for the <br />Law Enforcement Center on the September 22, 2008 Agenda as a Consent item. <br />New Government Complex to be Located at the "Old Fairgrounds" - Selection o£ <br />Architect <br />Mike Downs, Deputy County Manager, presented a request for the Board to <br />schedule a meeting to interview architectural firms for the new Government <br />Complex to be located at the "Old Fairgrounds". He reported the County <br />received nine responses to the Request for Qualifications (RFQ) and the <br />assigned committee selected six of the nine firms to interview. He further <br />reported the interviews have been completed and the committee recommends the <br />Board of Commissioners interview the following four architectural firms: ADW <br />Architects, Inc.; LS3P Associates, LTD; Narmour Wright Creech Architecture; <br />and Yates, Chrietzberg, Hughes Architects. <br />Following a brief question and answer session, the Board agreed to <br />schedule a meeting to interview the aforementioned architectural firms on <br />October 1, 2008 in the Multipurpose Room at the Governmental Center from 8:30 <br />to 11:00 a.m. Further, the Board agreed that each firm would be allotted 30 <br />minutes and copies of their proposals will be posted on the County's website <br />for review prior to the meeting. <br />and Safety Nui <br />John Day, County Manager, reported a large pile of trash on the <br />property of Michael J. Howard located at 6291 Old Salisbury-Concord Road in <br />Kannapolis, is visible from the road. This trash was originally held in a <br />roll-off container, but was dumped in the yard by the container owner when <br />the bill was unpaid. <br />Richard Koch, County Attorney, addressed the following issues: a <br />response was not received to a letter sent on August 13, 2008 demanding the <br />property owner clean the debris within 10 days; at the same time the Cabarrus <br />Health Alliance instituted a legal proceeding to obtain cleanup; however, <br />there were service process issues related to a recent hearing; N.C.G.S. 153A- <br />140 allows the County to clean the property and place a lien on the property <br />in an amount equal to the cost of cleanup; to comply with the statute, <br />another letter must be sent to Mr. Howard advising him of his right to <br />challenge the proceeding in court before the County can clean up the debris; <br />and due to the amount of time that has lapsed and the unsuccessfulness of <br />previous efforts, authorization to send the aforementioned letter was <br />requested. <br />A discussion ensued. The following issues were addressed: number of <br />attempts to contact the owner; the owner was advised in August this offense <br />is a Class 3 misdemeanor; etc. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Carruth and <br />unanimously carried, the Board suspended its Rules of Procedure in order to <br />take action tonight on the letter to Mr. Michael J. Howard. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Carruth and <br />unanimously carried, the Board authorized the County Attorney to write a <br />letter to Mr. Howard advising him of the County's decision to clean up the <br />property and place a lien on his property for the cost. <br />Mr. Koch asked the Board for clarification that the motion included <br />approval for the County to proceed in accordance with that letter.
