September 22, 2008 (Regular Meeting) Page 970 <br />Jonathan Marshall, Commerce Director, presented information related to <br />a request for a Reservation of Capacity Certificate for the Wellspring <br />Village Project. He stated Wellspring Village, consisting of 52 multi-family <br />units on +/- 6.53 acres located off of Pitt School Road in Concord, is a <br />project directed towards older adults and should not generate any school <br />children within the development. He also stated the developer has been <br />working directly with Richard Koch, the County Attorney, throughout the <br />process, and it is suggested that the Board approve the project's exemption <br />from Adequate Public Facility Ordinance (APFO) requirements, upon compliance <br />with standards set forth by the County Attorney. <br />Mr. Koch reported Dean Edwards, Vice President of Crosland Homes, the <br />developer for the Wellspring Village Project, is present and available to <br />respond to questions. He reported that the Board previously approved an <br />exemption for the Villas at Forrest Park, which was also a senior citizens <br />project, subject to the following conditions: (1) that the project be <br />restricted to senior citizens only, to the extent allowed by Fair Housing <br />laws; (2) that the County is provided with an annual certification that there <br />are no students living in the project, subject to audit by the County; (3) <br />that the project be subject to the prevailing APFO fees if a child is found <br />to reside at the project. In closing, he said the Wellspring Village Project <br />could be approved for exemption in a similar manner as the Villas at Forrest <br />Park project. <br />In response to a question posed by Commissioner Privette, Mr. Koch <br />reported that if a child resides with a grandparent in the complex, a <br />voluntary mitigation payment must be made by the developer as a result. <br />Mr. Edwards stated the Wellspring Village Project is a 48 unit complex <br />aimed at seniors 55 years and older. He reported the following: the <br />community will be subject to deed restrictions and lease terms which state <br />that residents must be aged 55 years or older; this project is funded by <br />Federal tax credits and City of Concord HOME funds, and must comply with the <br />Fair Housing Act; the developers can complete an annual certification; any if <br />children are found to be residing in the project on a permanent basis, the <br />tenant will be given notice to remedy the situation or be evicted. He <br />responded to additional questions from the Board. <br />UPON MOTION of Vice Chairman Juba, seconded by Commissioner Carruth and <br />unanimously carried, the Board voted to exempt the Wellspring Village Project <br />from the Adequate Public Facilities Ordinance (APFO), subject to following <br />conditions: (1) implementation of deed restrictions consistent with Fair <br />Housing laws as they relate to senior projects; (2) completion of an annual <br />certification subject to audit; and (3) payment of the prevailing APFO fees <br />if it is determined that a child permanently resides at the project and <br />attends school. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Juba and <br />unanimously carried, the Board tabled the Consent Agreement for the Crescent <br />Heights Retirement Apartment Project until the October 6, 2008 Agenda Work <br />Session as requested by the applicant. <br />41 Finance - <br />Dr. Jo Anne Byerly, Superintendent of Kannapolis City Schools, <br />presented information related to the replacement of the Kannapolis <br />Intermediate School roof. After she reviewed facts and figures regarding <br />Duro-Last roofing and standing seam metal roofing, she recommended the <br />existing roof be replaced with a standing seam metal roof. She also <br />responded to questions from the Board regarding the structural integrity and <br />future uses of the school building. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board approved the proposal submitted by Joe <br />Sides with Cabarrus County Schools for the replacement of the gymnasium roof <br />with a standing seam metal roof at Kannapolis Intermediate School in the <br />amount of $226,815.00.
