December 1, 2008 (Work Session) Page 1074 <br />Zoning Board had initially been given the rezoning packages that followed the <br />adoption of the Central Area Plan in September; the Board had another <br />discussion regarding the plan at their October meeting, and subsequently had <br />smaller group meetings with County staff to get a better understanding of <br />plan recommendations as it relates to the rezoning; in November, the Planning <br />and Zoning Board voted 6 to 3 in favor of the rezoning; because the vote was <br />less than a 75 percent majority, the plan will come back before the Board of <br />Commissioners; this item will need to be brought to the Board in January so <br />that staff members can send out a mass mailing to the public; the hearing <br />will be a de novo hearing to be held at the January 20, 2009 regular meeting; <br />etc. <br />Commissioner Carruth asked about an email he sent to Mr. Marshall with <br />questions regarding zoning classifications. Chairman White suggested that <br />Mr. Marshall have answers to all questions posed by the Board at the January <br />Work Session. <br />Vice Chairman Mynatt commented that even though she will be recusing <br />herself from the vote regarding this plan, she would like to know the reasons <br />for a split vote by the Cabarrus Planning and Zoning Commission. Mr. <br />Marshall reported the meeting minutes will be provided upon adoption. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Mynatt <br />and unanimously carried, the Board voted to place the Central Area Land Use <br />Plan on the January 20, 2008 Agenda as a New Business item for a de novo <br />hearing. <br />Commerce Department - Consent Agreement for the Edison Square Condominium <br />Project <br />Jonathan Marshall, Commerce Director, presented the following <br />information regarding a Consent Agreement for the Edison Square Condominium <br />Project: <br />The Edison Square condominium project was approved by the City of <br />Concord Planning and Zoning Board on June 20, 2006. The project <br />consists of 168 condominium units on +/-31.65 acres located at <br />the intersection of Harris Road and Ellenwood Drive. The <br />specifics of the agreement are as follows: <br />• Developer - Shea Homes, LLC, 3936 Toringdon Way, Suite 100, <br />Charlotte, NC 28210. <br />• Payment of $1,331 per unit will be paid prior to building <br />permitting. <br />• Build out schedule would be no more than 45 multi-family <br />residential condominium unit building permits issued in <br />calendar year 2009, no more than 95 multi-family residential <br />condominium unit building permits issued in calendar year <br />2010, no more than 45 multi-family residential condominium <br />unit building permits issued in calendar year 2011, and no <br />more than 33 multi-family residential condominium unit <br />building permits issued in calendar year 2012. <br />The APFO worksheet filled out by Mr. Robert Kluttz with Cabarrus <br />County Schools indicates that schools impacted by the Edison <br />Square condominium project are currently functioning at the <br />following capacities: <br />Cox Mill Elementary School - 86.2$ <br />Harris Road Middle School - 122.5 <br />Northwest Cabarrus High School - 128.2 <br />Including previously approved subdivisions and additional <br />capacity from funded improvements in the Capital Improvement <br />Plan, these schools will be functioning at the following capacity <br />upon completion of the Edison Square condominium project: <br />Cox Mill Elementary School - 134.32 <br />Harris Road Middle School - 112.70 <br />Northwest Cabarrus High School - 92.38$ <br />The Capital Improvement Plan includes the Cox Mill High School, <br />projected to open in August 2009 and will provide relief to <br />Northwest Cabarrus High School. The CIP also includes a new <br />middle school in 2010 in the south central part of the county <br />
