March 26, 2007 (Regular Meeting) <br />Page 306 <br />(F-16) Hudget Amendment - Additional Soil 6 Water Conservation Grant Funda <br />UPON MOTION of Commissioner White, seconded by Commissioner Privette <br />and unanimously carried, the Board adopted the following budget amendment: <br />BUDGET REVISION/AMENDMENT REQUEST <br />DEPARTMENT OF COMMERCE/SOIL & WATER <br />AMOUNT: $ 825.00 <br />TYPE OF ADJUSTMENT: Supplemental Request <br />PURPOSE OF REQUEST: Grant and donations totaling $825 received to conduct <br />Working Lands Conservations workshops. Additional funds of $175 transferred <br />from within the department for the total event budget. <br />Arrnnnt Nn <br />00169210-6365-EVENT <br />Soil & Water Grants <br />00169210-6803 <br />Miscellaneous Revenue <br />00194210-9916-EVENT <br />Soil & Water Grants <br />00199210-9325 <br />Postage <br />$0.00 <br />$0.00 <br />$1,900.00 <br />Increase Decrease Revised Budget <br />$500.00 $500.00 <br />$325.00 $325.00 <br />$1,000.00 $1,000.00 <br />$175.00 $1,225.00 <br />(F-17) Ware Honsall Contract Amendment No. 10 <br />Item F-17 was moved to New Business. <br />RESOLUTION <br />Resolution No. 2007-07 <br />A RESOLUTION FOR CABARRUS COUNTY WITH RESPECT TO THE FEES TO BE CHARGED BY <br />THE SHERIFF FOR SERVICE OF PROCESS ORIGINATING OUTSIDE OF THE GENERAL COURT <br />OF JOSTICE OR OTHER NORTH CAROLINA COURTS OR AGENCIES <br />WHEREAS, North Carolina General Statute Section 153A-102 grants the Board of~ <br />Commissioners the power to fix the fees and commissions charged by county <br />officers and employees for performing services or duties permitted or <br />required by law; <br />WHEREAS, the Sheriff and his deputies are permitted, but not required, to <br />serve summons and complaints and other legal process issued by the federal <br />courts and courts of the several states, other than North Carolina; and <br />WHEREAS, the provisions of North Carolina General Statute Section 7A-311 <br />which set uniform fees for service of civil process only apply to process <br />issued by the courts of North Carolina; <br />BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF CABARRUS COUNTY: In <br />any civil action of special proceeding arising in the federal courts of in a <br />court of one of the several States other than the State of North Carolina, <br />the following fees shall be assessed, collected, and remitted to the county: <br />Effective March 26, 2007, for each item of civil process, including summons <br />and complaints, subpoenas, notices, motions, orders, and pleadings served, a <br />fee of fifty dollars ($50.00) will be charged. When two or more items of <br />civil process are served simultaneously on one party, only one fifty dollar <br />($50.00) fee shall be charged. <br />When an item of civil process is served on two or more persons or <br />organizations, a separate service charge shall be made for each person or <br />organization. <br />This resolution shall not apply to any process issued by the North Carolina <br />General Court of Justice or any other court, administrative body, or agency <br />of the State of North Carolina or any of its political subdivisions. <br />Present <br />Approved Budget <br />$0.00 <br />Adopted this the 26`" day of March, 2007. <br />UPON MOTION of Commissioner White, seconded by Commissioner Privette <br />and unanimously carried, the Board adopted the following resolution: <br />
