April 2, 2007 (Work Session) Page 324 <br />refunds of Planning and Zoning fees on the April 16, 2007 Agenda as a New <br />Business item. <br />Cabarrus County Fire Marshal's Office Recommended Boundary Changes to the <br />Cabarrus County Fire Insurance Distriota Under Their Jurisdiction <br />Steve Langer, Assistant Fire Marshal, asked the Board to schedule a <br />public hearing on May 21, 2007 to consider proposed boundary changes to the <br />Cabarrus County Fire Insurance Districts under the Fire Marshal's <br />jurisdiction. He explained there is not enough time to get the advertisement <br />in the newspaper before April meeting. Mr. Langer and Bobby Smith, the <br />Emergency Management Director, responded to several questions from the Board <br />on changing the boundaries and unprotected areas. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner White <br />and unanimously carried, the Board scheduled a public hearing on the <br />recommended boundary changes to the Cabarrus County Fire Insurance Districts <br />on May 21, 2007 at 6:30 p.m. <br />Consent Agreement - Melbourne Subdivision <br />John Day, County Manager, reported the developer, Gandy Communities, <br />requested consideration of the Consent Agreement for the Melbourne <br />Subdivision be deferred until the Board's May meeting. He further reported <br />the Consent Agreement was previously tabled to the April meeting and asked <br />the County Attorney if the Board could take action on this request. <br />Richard M. Koch, County Attorney, stated the Board could take action on <br />the request since it was initiated by the applicant. <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Juba and <br />unanimously carried, the Board tabled its consideration of the Consent <br />Agreement for the Melbourne Subdivision until the May meeting. <br />Consent Agreement - Roycroft 3ubdivieion <br />Kassie G. Watts, Planner, reported the Roycroft subdivision, developed <br />by T.D.W. Holdings, LLC of Charlotte, N.C., was approved by the Cabarrus <br />County Planning and .Zoning Board on March 15, 2007 and consists of 361 <br />single-family residential units on +/-262.92 acres located on Flowes Store <br />Road. A consent agreement to address school APFO (Adequate Public Facility <br />Ordinance) requirements is required for the project to proceed. The Consent <br />Agreement includes the payment $9,039.00 per lot to advance school adequacy <br />that will be due at final platting and the following proposed build-out <br />schedule: no more than 99 lots platted in 2008, no more than 99 lots platted <br />in 2009, no more than 99 lots platted in 2010, and no more than 69 lots <br />platted in 2011. Finally, she reported said the APFO worksheet includes the <br />opening of Hickory Ridge High School and the numbers from the Saddlebrook <br />Subdivision which is located in the same area. <br />Ms. Watts responded to questions on the capacity percentage at Rocky <br />River Elementary without the A.T. Allen and Mt. Pleasant satellites. <br />There was a general discussion on capacity issues and growth in the <br />area south of Highway 99 and west of Highway 601. <br />UPON MOTION of Commissioner White, seconded by Commissioner Privette <br />and unanimously carried, the Board voted to place the Consent Agreement for <br />Roycroft Subdivision on the April 16, 2007 Agenda as a New Business item. <br />Consent Agreement - Saddlebrook Subdivision <br />Kassie G. Watts, Planner, reported the Saddlebrook subdivision, <br />developed by Saddlebrook Subdivision, LLC of Charlotte, N.C., was approved by <br />the Midland Town Council on March 13, 2007 and consists of 286 single-family <br />residential units on +/-108.91 acres located on Bethel School Road. She said <br />a consent agreement'. to address school APFO (Adequate Public Facility <br />Ordinance) requirements is required for the project to proceed. The Consent <br />Agreement includes the payment of $9,034.00 per lot that will be due at final <br />platting and the following proposed build-out schedule: no more than 78 lots <br />platted in 2008, no more than 68 lots platted in 2009, no more than 88 lots <br />platted in 2010 and no more than 39 lots platted in 2011. She commented on <br />the capacity of Bethel Elementary School, Central Cabarrus High School and <br />the projected opening of Hickory Ridge High School in August 2007. <br />
