June 18, 2007 (Regular Meeting) <br />Page 941 <br /> may also be required to provide the name, address and phone number of the <br /> customer for which the sample was provided. <br />(f) Upon failure to maintain structures in a proper condition of cleanliness, <br /> failure to have a currently valid permit from the North Carolina <br /> Department of Solid Waste or failure to pay charges due to WSACC as <br /> hereinafter provided, WSACC may deny a contracte~ hauler permission to <br /> <br />,~~- ^,•.a^- ,_a waste -' `-='^`^ into the <br />dispose of r <br /> sewer system and/or revoke or suspend the discharge permit. WSACC will <br /> notify the Cabarrus Health Alliance ~Bega~en~ and/or State of such <br /> denial of permission to any contracte~ hauler. <br />' <br />(g) Failure of the contracte~ hauler to comply in accordance with the <br /> ordinance or septage discharge permit or the submission of false or <br /> misleading information on an application may result in revocation of <br /> permit and/or penalties as provided for in Section 8. <br />(h) The contract hauler is responsible for any and all damages resulting from <br /> improper handling and/or spillage. <br />(i) User fees shall be established at a rate to recover the cost of treatment <br /> and administration of the contract hauler program. Fees and payment <br /> policy shall be approved by the Board of Directors and shall be paid in <br /> accordance with the procedure established by the Executive Director. <br />SECTION 3 - FEES <br />3.1 Purpose <br />It is the purpose of this section to provide for the recovery of costs from <br />users of WSACC's wastewater disposal system for the implementation of the <br />program established herein. The applicable charges or fees shall be set forth <br />in WSACC's schedule of charges and fees by the Executive Director and approved <br />by the Board of Directors A copy of these charges and fess will be made <br />available from the Executive Director. <br />3.2 User Charges <br />A user charge shall be levied on all users including, but not limited to <br />persons, firms, corporations or governmental entities that discharge, cause or <br />permit the discharge of sewage into the POTW. <br />(a) The user charge shall reflect at least the cost of debt service, <br />operation and maintenance (including replacement) of the POTW. <br />(b) Each user shall pay its proportionate cost based on volume of flow. <br />(c) The Executive Director shall review annually the sewage <br />contributions of users, the total costs of debt service, operation <br />and maintenance of the POTW and will make recommendations to the <br />Board of Directors for adjustments in the Rate Schedule as <br />necessary. <br />(d) Charges for flow to the POTW not"directly attributable to the users <br />shall be distributed among all users of the POTW based upon the <br />volume of flow of the users. <br />' 3.3 Surcharges <br />All industrial users of the POTW are subject to industrial waste surcharges on <br />discharges which exceed the following levels: <br />BOD - 300 MG/L <br />COD - 675 MG/L <br />TSS - 250 ia-5 MG/L <br />NH3 - 15 MG/L <br />Oil/Grease -100 MG/L <br />Aluminum - 1.80 MG/L <br />
