An <br />industrial user shall never increase the amount of water to dilute pollutant <br />concentrations to avoid or reduce surcharges. ""~- ~-t ~---_a <br />° .: , , " : »-tkr~8t~-eha ge-Fate , <br />(a) The volume of flow used in determining the total discharge of wastewater <br />for payment of user charges and surcharges shall be based on the <br />following: <br />(1) Metered water consumption as shown in the records of meter readings <br />maintained by WSACC. If a person discharging wastewater into the <br />public sewers produces evidence to the Executive Director that a <br />significant percent of the total annual volume of water used for <br />all purposes does not reach the public sewers, then an estimated <br />percentage of total water consumption to be used in determining <br />non-domestic wastewater discharge may be agreed upon between the <br />Executive pirector and the person discharging such non-domestic <br />wastewater into the public sewer. The Executive Director shall <br />ascertain whether substantial evidence has been provided to prove a <br />significant percent of water does not reach the public sewers; or <br />(2) If required by WSACC or at the individual discharges option, other ' <br />flow monitoring devices which measure the actual volume of <br />wastewater discharged to the sewer. Such devices shall be <br />accessible and safely located, and the measuring system shall be <br />installed in accordance with plans approved by WSACC and the <br />governinq municipality. The metering system shall be installed and <br />maintained at the users expense according to arrangements that may <br />be made with WSACC. <br />(3) Where any user procures all or part of his water supply from <br />sources other than WSACC, the user shall install and maintain at <br />his own expense water meters of a type approved by WSACC for the <br />purposes of determining the proper volume of wastewater discharged <br />to such sewers. <br />(b) The character and concentration of the constituents of wastewater used in <br />determining surcharges shall be determined by samples collected and <br />analyzed by WSACC. Samples shall be collected in such manner as to be <br />representative of the actual discharge and shall be analyzed using <br />procedures set forth in 90 CFR Part 136. <br />(c) The determination by the Executive Director or his duly appointed <br /> representatives of the character and concentration of the wastewater <br /> discharge shall be binding as a basis for charges. <br />(d) Any source that discharges non-domestic wastewater in <br />levels listed above ma <br />be subject t <br />h excess of the ' <br /> y <br />o surc <br />arges. <br />(e) The Executive Director may assess surcharges to users to recover any <br /> additional costs incurred by WSACC for the handling and disposal of <br /> sludge. <br />3.9 Pretreatment Program Administration Charges <br />
