<br />February 20, 2006 - Regular Meeting <br /> <br />Page <br /> <br />512 <br /> <br />00161710-6804 <br />Insurance Funds <br />00191225-9331 <br />Minor Equipment <br /> <br />$26,700.00 <br /> <br />$17,000.00 <br /> <br />$43,700.00 <br /> <br />$0.00 <br />and Furniture <br /> <br />$17,000.00 <br /> <br />$17,000.00 <br /> <br />(F-11) Sewer Line Easement at Concord Middle School and Adoption of Related <br />Budget Amendment <br /> <br />The Board received the request from a private development company to <br />purchase a short easement to construct a sewer line across County property on <br />NC 73 at Concord Middle School. <br /> <br />commissioner Carpenter stated a letter from Liz Poole, Cabarrus County <br />School Board Chair, advised that the School Board denied the request. <br /> <br />Jonathan Marshall, Commerce Director, reported several issues were <br />raised at the School Board's meeting. The primary issue was the School Board <br />did not have a precedent for transferring easements to private developers. <br />He explained that in this proposal a private developer would be paying for <br />the easement but the transfer of that easement would be to the City of <br />Concord. Mr. Marshall stated the easement would allow the installation of a <br />gravity sewer line which would be a better means of serving the subdivision. <br /> <br />Dale Fink, the engineer for the Pleasant Oaks Subdivision, said the <br />developer plans to run a force main in the NC 73 right-of-way up to the Gold <br />Hill Road area. He outlined plans to eliminate an existing pump station and <br />replace an existing force main with a gravity line from the Water and Sewer <br />Authority interceptor. <br /> <br />Liz Poole, County School Board Chair, reported that the Schools <br />typically transfer rights-of-way to municipalities or utility companies, but <br />have not given rights-of-way to developers. She stated it was the School <br />Board's position that to give a right-of-way to a development would be <br />encouraging growth and more overcrowding of schools. <br /> <br />Mr. Marshall reiterated the developer would be buying the easement and <br />constructing the sewer line, but the easement and the infrastructure would be <br />part of the sewer system for Concord. <br /> <br />vice Chairman Juba made a motion to approve the sale of the sewer line <br />easement on property at Concord Middle School for $5,000.00 with execution of <br />the Easement Agreement by the County Manager and to approve the required <br />budget amendment to transfer those funds to Cabarrus County Schools for use <br />by Concord Middle and Irvin Elementary. Chairman Carruth seconded the <br />motion. <br /> <br />There was further discussion regarding the requested easement. Mr. <br />Marshall advised the subdivision had received all approvals and could be <br />built with a different means to provide sewer if the easement was not <br />granted. <br /> <br />Chairman Carruth suggested that the issue be tabled to February 27. <br /> <br />Vice Chairman Juba withdrew her motion to approve the subdivision. <br /> <br />The Board voted unanimously to table the item until February 27. <br /> <br />NEW BUSINESS <br /> <br />(G-1) HOME Program Public Hearing - Public Hearing - 6:30 p.m. <br /> <br />Kelly Sifford, Community Development Manager, presented information on <br />the HOME Program, a housing rehabilitation program for low-income persons. <br />She reported that Rowan County would be participating in the program this <br />year, thus reducing Cabarrus County's funding to approximately $136,000.00 <br />for administration and housing rehabilitation activities. A 25 percent match <br />is required. <br /> <br />At 10:42 p.m., Chairman Carruth opened the public hearing and asked if <br />anyone wished to address the Board regarding the HOME Program. The Public <br />Hearing Notice was published in THE INDEPENDENT TRIBUNE on February 10 and <br />12, 2006. <br /> <br />There was no one present to address the Board, and Chairman Carruth <br />closed the public hearing. <br />
