December 4, 2006 (Organizational/Recessed Meeting) <br />Page 190 <br />Chairman Carruth suggested Commissioner Mynatt, Vice Chairman Juba and <br />the County Manager work together to determine the makeup and purpose of the <br />committee and to report back on December 18. <br />Commissioner White asked to have the idea of using a moderator <br />considered and to determine who would pay the cost. <br />Commissioner Privette withdrew his original motion. <br />Commissioner Privette made a MOTION that Commissioner Mynatt and Vice <br />Chairman Juba be named to form a committee to study the feasibility of the <br />proposed public safety facility. <br />Commissioner Mynatt seconded the motion. The motion unanimously <br />carried. <br />Recess of Meeting <br />At 8 p.m., Chairman Carruth announced the Board would take a short <br />recess to relocate to the Multipurpose Room and upon the arrival of Sheriff <br />Riley, the Board would go into Closed Session. <br />The meeting reconvened at 8:12 p.m. <br />(H)- CLOSED SESSION <br />(H-1) Closed Session to .Consult with the County Attorney to Preserve the <br />Attnrnev-Client Privilege and to Consider a Personnel Matter(s) as Authorized <br />UPON MOTION of Chairman Carruth, seconded by Vice Chairman Juba and <br />unanimously carried, the Board moved to go into Closed Session and invited <br />Sheriff~Riley to join the meeting. <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Juba, and <br />unanimously carried, the Board moved to come out of Closed Session at 8:55 <br />p.m. <br />The Board relocated to the Multipurpose Room (MPR) for the remainder of <br />the meeting. <br />- Castlebrook Manor Subdivision, Consent Agreement - Landon <br />mnwnh~me Subdivision. Consent Acreement - Newman Manor Subdivision, Consent <br />Jonathan Marshall, Commerce Director, reported a Consent Agreement is <br />the portion of a development's approval that comes before the Commissioners; <br />it is the end result of the County's Adequate Facilities review that deals <br />with school adequacy and it is the only approval function the County has. In <br />most cases, he said the developments are within the cities of Concord, <br />Kannapolis, Harrisburg, Mt. Pleasant and Midland. He said the Newman Manor <br />Subdivision is located within the City of Kannapolis but is in the County's <br />school district. He reported adequate facilities reviews were extended to <br />Concord and Kannapolis several years ago, the County notified the developer <br />in July 2006 that they were subject to this review and would need to enter <br />into a Consent Agreement because schools were determined to be inadequate. <br />He said the developer did not move forward with the Consent Agreement at that <br />time and has recorded a final map for 29 lots. He said the developer is <br />ready to pull building permits for this subdivision, but cannot until the <br />Consent Agreement is approved. Because the final map has already been <br />recorded, which typically trigger the mitigation payment, he said the <br />developer is proposing a "take down" or "purchase schedule" that lasts <br />approximately two years. He stated the developer would like for the Consent <br />Agreement to reflect the purchase schedule and the developer will pay the <br />mitigation amount according to the schedule. <br />UPON MOTION of Commissioner Privette, seconded by Commissioner White <br />and unanimously carried, the Board voted to place Consent Agreements for the <br />following subdivisions on the December 18, 2006 Agenda as New Business items: <br />Castlebrook Manor Subdivision, Landon Townhome Subdivision, Newman Manor <br />Subdivision, and Shiloh Village Subdivision. <br />Hlock Grant (CDBG) 2007-2009 Scattered Site <br />
