<br />July 14, 2005 - Regular Meeting <br /> <br />Page <br /> <br />263 <br /> <br />vice Chairman Carruth reported the Board would be discussing property <br />acquisition/business relocation issues at a work session on August 8. <br /> <br />Jerry Williamson of Concord asked several questions about the jobs to <br />be created by Golden Gait Trailers (GGT) through the Industrial Incentive <br />Grant program. He asked where GGT was originally located and stated such <br />items should be thoroughly investigated before tax dollars are given away. <br />Further I he questioned the status of the County Attorney's reimbursement of <br />the $130,000.00 settlement and the posting of the county attorney position. <br /> <br />Mack Neikirk said he had spoken to several Board members individually <br />on different occasions and asked for the Board's help at a previous meeting. <br />He said no one wanted to help him. He reported County staff were <br />overstepping their boundaries and harassing him for reporting a code <br />enforcement problem several years ago. In the meantime I he said his fees <br />were escalating. He advised that he had hired an attorney to handle the <br />situation. <br /> <br />There was no one else present who wished to address the Board, and <br />Vice Chairman Carruth closed that portion of the meeting at 7:06 p.m. <br /> <br />(E) OLD BUSINESS <br /> <br />(E-l) Consent Agreements for Subdivisions Approved within the City of <br />Concord (tabled on May 23 and July 14) <br /> <br />John Day, County Manager, reported the intent was to hold the <br />applications for the subdivisions located within the City of Concord until <br />the new Adequate Public Facilities Ordinance (APFO) and the school adequacy <br />review methodology were adopted. He stated the ordinances were not complete <br />but he expected to have a preliminary draft for review at the meeting on <br />August 8. He suggested the Board table the Consent Agreements until such <br />time as the new APFO has been adopted. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />and unanimously carried, the Board tabled the Consent Agreements for <br />subdivisions approved within the City of Concord until such time as the new <br />Adequate Public Facilities Ordinance is adopted. <br /> <br />(E-2) <br /> <br />Update on Concord Motorsports Park <br /> <br />John Day, County Manager, reported a community meeting was held in May <br />to addresses concerns from some residents around Concord Motorsports Park. <br />The meeting was well-attended by residents and track officials, as well as a <br />NASCAR representative. The primary concern of the residents appeared to be <br />the loudness of the Bandolier and Legend racecars which do not have mufflers. <br />Mr. Day stated the track officials had voluntarily agreed to require mufflers <br />on these cars starting in August. He also reported that track officials had <br />advised they make a concerted effort to make sure all events end at 10: 00 <br />p.m. on weekends. Because Concord Motorsports Park has petitioned for <br />voluntary annexation into the Town of Midland, Mr. Day did not recommend any <br />changes to the Noise Ordinance or other regulations at this time. <br /> <br />(F) CONSENT AGENDA <br /> <br />(F-l) Register of Deeds - Authorization to Refund Excise Stamp ($350) to <br />Douglas K. Simmons & Associates PLLC <br /> <br />Linda McAbee, Register of Deeds, submitted the request by Attorney <br />Douglas K. Simmons for the refund of $350.00 for a deed for Gaston County <br />property (Lot No. 11, Block "A", Phase 1 of Riverwood Plantation Subdivision) <br />that he erroneously recorded in Cabarrus County. At the time of recording, <br />Mr. Simmons paid $350.00 in excise stamps. <br /> <br />UPON MOTION of Commissioner privette, seconded by Vice Chairman Carruth <br />and unanimously carried, the Board authorized a refund in the amount of <br />$350.00 to Attorney Douglas K. Simmons for a deed that was recorded in <br />Cabarrus County rather than Gaston County, pursuant to NC General Statute <br />105.228.37. <br /> <br />(F-2) <br /> <br />Register of Deeds - Logan Systems Contract for FY 2006 <br />
