<br />October 17, 2005 - Regular Meeting <br /> <br />Page <br /> <br />373 <br /> <br />Rodger Lentz, Planning and Zoning Manager, presented information on <br />Case #C05-02(T), a Zoning Text Amendment for a Recreational District Overlay <br />Zone that would permit certain recreational uses through the application of a <br />zoning overlay district. He reported the Planning and Zoning Commission <br />unanimously recommended approval of the proposed text amendment. <br /> <br />At 7:42 p.m. Chairman Carpenter opened the public hearing on the Zoning <br />Text Amendment - Case # C05-02(T) - Recreational District Overlay Zone. The <br />public hearing notice was published in THE INDEPENDENT TRIBUNE on October 6 <br />and 16, 2005. <br /> <br />Tab Glenham of 7660 Reed Mine Road in Midland stated his plans to build <br />a "Country BarnH on one acre of his property (not to exclude five additional <br />acres for parking if needed). He reported the structure would be an indoor <br />recreational facility that would be used to provide family entertainment for <br />the community of Georgeville and the surrounding area. The "Country Barn" <br />would offer various types of music for families to enjoy dancing on Friday <br />and Saturday nights and could also be used for private music and dance <br />instruction, private parties and meeting space for the community during the <br />week. <br /> <br />There was no one else present to address the Board, and Chairman <br />Carpenter closed the public hearing. <br /> <br />UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Juba and <br />unanimously carried, the Board adopted the following Ordinance: <br /> <br />Ordinance No. 2005-18 <br /> <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br /> <br />Change Chapter 4, Part IV, Recreational District Overlay Zone as follows: <br /> <br />PART IV. RECREATIONAL DISTRICT OVERLAY (RDO) ZONE <br /> <br />Section 4-20. Intention. <br /> <br />Application of the ROO Recreational Overlay Zone is intended to allow and <br />regulate certain recreational land uses in residential and agricultural zoning <br />districts that do not permit recreational activities by-right. <br /> <br />Section 4-21. Permitted uses. <br /> <br />Any use permitted in the applicable underlying zoning districts shall be <br />allowed. <br /> <br />section 4-22. Conditional uses. <br /> <br />Any conditional use permitted in the applicable underlying zoning <br />district may be allowed, as well as: <br />. Dance Halls <br />. Studios (artist, dance, music, etc) <br />. Live theater <br />. Bands, orchestras, and other musical entertainment <br />. Fitness Centers <br />. Membership sports and recreational clubs <br />. Indoor swimming pools <br />. Skating rinks <br />. Bowling alleys <br />. Indoor sports facilities and practice facilities <br /> <br />Section 4-23. Development standards. <br /> <br />Development standards required of the underlying zoning district shall be <br />applied in addition to any provisions required by an approved conditional use <br />permit for any recreational use. <br /> <br />In addition, the following requirements shall be met: <br /> <br />A) Site Plan. An approved site plan as described in Part I, Chapter 12, if <br />required. <br />
