<br />November 21, 2005 (Regular Meeting) <br /> <br />Page <br /> <br />417 <br /> <br />At 7:48 p.m. Chairman Carpenter opened the public hearing on the <br />proposed Zoning Text Amendment [C05-06 (T)] . The public hearing notice was <br />published in THE INDEPENDENT TRIBUNE on November 10 and 20, 2005. <br /> <br />There was no one present to address the Board, and Chairman Carpenter <br />closed the public hearing. <br /> <br />UPON MOTION of Vice Chairman Carruth, seconded by Commissioner Freeman <br />and unanimously carried, the Board adopted the Ordinance Amending the Zoning <br />Ordinance (Ordinance 2005-21) for County Sign Standards as submitted in the <br />Agenda package and incorporating the two changes as outlined by Rodger Lentz, <br />Planning and Zoning Manager. Ordinance 2005-21 as adopted by the Board is on <br />file in the County Manager's Office and included by reference as a part of <br />the minutes. <br /> <br />(G-3) Plat Extension Request - Consent Agreement Renewal for Peach Orchard <br />Estates <br /> <br />Rodger Lentz, Planning and Zoning Manager, reported the Peach Orchard <br />Estates Subdivision was approved on January 15, 2004, with the original <br />approval valid for two years. The subdivision straddles the Mecklenburg and <br />Cabarrus County line and there was a delay in approvals by Mecklenburg <br />County. The developer I Hayden McMahon Development, Inc. I requested a time <br />extension that was granted by the Planning and Zoning Commission in October, <br />2005. The approval contained several conditions, including the re-approval or <br />re-negotiation of the Consent Agreement for school adequacy by the Board. Mr. <br />Lentz stated the Board has an opportunity to renew, re-negotiate or not <br />approve the Consent Agreement. Renewing the agreement would keep the <br />adequacy contribution at $1,008.00 per lot. <br /> <br />Marion Sandlin of Concord Engineering & Surveying, Inc., reported the <br />developer had received all the required approvals. He stated he was available <br />to answer technical questions about the project. <br /> <br />Jerry Newton, speaking on behalf of the property owner, stated the <br />property owner was in agreement with renegotiating the Consent Agreement. He <br />said the required sewer improvements were not expected to be completed within <br />the two-year time period due to delays in getting the necessary reviews and <br />approvals. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Chairman Carpenter <br />and unanimously carried, the Board agreed to renegotiate the Consent <br />Agreement for the Peach Orchard Estates Subdivision, including a contribution <br />for the advancement of school adequacy of $4,034.00 per lot, and authorized <br />the County Manager to execute the Consent Agreement subject to review and <br />revision by the County Attorney. <br /> <br />(G-4) Employee Appreciation Day Donation of Funds <br /> <br />Don Cummings, Human Resource Director, presented a request on behalf of <br />the Employee Appreciation Committee and Cabarrus County employees to forego <br />the annual Employee Appreciation Day activities and donate those funds to <br />local nonprofit agencies to assist hurricane victims who have relocated to <br />Cabarrus County. <br /> <br />UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman <br />and unanimously carried, the Board approved Cabarrus County employees <br />foregoing the annual Employee Appreciation Day and donating the money that <br />would have been spent to assist the continuing needs of hurricane victims in <br />the area. Further, the Board authorized the Employee Appreciation Committee <br />to recommend and the County Manager to approve the distribution of the funds <br />up to $10,000.00 to local non-profit agencies. <br /> <br />John Day, County Manager, updated the Board on the progress of the <br />annual fund drive by the employee-managed charitable committee called <br />Cabarrus Helping Hearts and Hands (Ch3). He reported the fund drive runs <br />through the end of November and $43,000.00 has been pledged to date. Mr. Day <br />also provided an update on the Ch3 Angel/Snowman Tree that will be in the <br />lobby of the Governmental Center beginning on December 1. <br /> <br />(G-s) N.C. Department of Transportation Purchase of Right-Of-Way on Harris <br />Road and Request by the Cabarrus County Board of Education that the $1,500 <br />Payment be Given to Harris Road Middle School <br /> <br />The N. C. Department of Transportation (NCDOT) has scheduled <br />construction to replace the bridge on Harris Road over the Rocky River. The <br />
