April 21, 2003 Page 93 <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Vice Chairman Suggs <br />and unanimously carried, the Board authorized the following revisions to the <br />Cabarrus County Personnel Ordinance as proposed in the Memorandums from Don <br />Cummings, Human Resources Director, and set forth below; and authorized the <br />actions necessary for implementation. <br /> <br />First Memorandum Dated April 11 <br />Subject: Proposed Personnel Ordinance Revisions <br /> <br />As directed, the following changes to the Personnel Ordinance, Article VI, Leaves of Absence, are <br />recommended to implement the Sheriff Department schedule change and provide equitable leave <br />accrual. A few housekeeping changes are included for correction, clarification and compliance. <br /> <br />The current Ordinance language is shown with the proposed changes. <br /> <br /> ARTICLE VI. LEAVES OF ~SENCE <br />Section 1. Holidays <br />The following days and such other days as the Commissioners may designate are holidays with pay <br />paid leave for employees and officers of the County working the basic work week of forty <br />hours. <br /> <br />New Year's Day <br />Martin Luther King, Jr.'s <br /> Birthday <br />Good Friday <br />Memorial Day <br />Independence Day <br />Labor Day <br /> <br />Veteran's Day (Nov. 11) <br />Thanksgiving Day <br />Day After Thanksgiving <br />Christmas -- Two (2) workdays <br /> -when Christmas falls on Friday, Saturday, Sunday or Monday (The <br /> County will observe the State Christmas Schedule);~ <br /> -when Christmas falls on Tuesday, Wednesday or Thursday (The <br /> County will observe Christmas Eve Day and Christmas Day). <br /> <br />When a holiday other than Christmas Day falls on a Saturday or Sunday, the County shall observe <br />the same day a~-the State of North Carolina observes fcr the holiday in ~dcstlcn. If a holiday a~ <br />designated by the-Ceun~y Personn~tthis Ordinance falls on a day other than Monday and is <br />designated nationally to be observed on a Monday, then the County policy is amended to observe <br />that holiday on a-the designated Monday. <br /> <br />Employees assigned to Emergency Medical Services with a schedule of on duty twenty-four (24) <br />hours and off duty forty-eight (48) hours shall have one ~hun4re~--~w~tve--~l-l~123 hours off per <br />year in lieu of the regular holidays. Law enforcement offlcers working a 12 hour shift schedule <br />shall have 92 hours off per year in lieu of the regular holidays. <br /> <br />Holiday leave credited to full time, part time, and temporary ~nd rcgular part timc employees <br /> <br />on the number of hours worked during their normal schedule on the day of the week that the <br />holiday or designated holiday falls, not to exceed e~ght (8) hours. ~a-~de~--Full t~me and part <br />time employees, not on paid leave, must work a full normally scheduled workday before or after <br />the holiday ~o be eligible for holiday leave, to bc cli~iblc for koliday icavc, a tTemporary <br />County employees must kavc worke~ a full normally scheduled workday before and after the holiday <br />~o be eligible for holiday leave. <br /> <br />Employees may wish to be away from work on certain day for religious observances. Department <br />heads should attempt to arrange the work schedule so that an employee may be granted annual leave <br />if it is requested because the day is a major religious observance for that employee. Annual <br />leave should be denied only when it would create an emergency condition which cannot be prevented <br />in any other manner. <br /> <br />Section 2. Effect of Work on Holidays or Unscheduled Workdays on Other Types of Paid Leave <br />Regular holidays or unscheduled workdays which occur during an annual, sick or other paid leave <br />period of any officer or employee of the County shall not be charged as annual, sick or other <br />leave. <br /> <br />Section 3. Holiday - When Work Required <br />Except for Emergency Medical Services and law enforcement personnel, employees who are required <br />to perform work on regularly scheduled holidays shall be granted compensatory time off in <br />accordance with the Wage and Hour Policy as contained in Appendix C. <br /> <br />Section 4. Annual Leave <br />Ail regular and probationary employees who are scheduled to work at least 1,000 hours during the <br />calendar year shall receive annual leave in accordance with this policy. Annual leave may be used <br />at the employee's discretion with the approval of the employee's supervisor. <br /> <br />Section 5. Annual Leave - Probationary Emp%oyees <br />An employee serving a probationary period following initial <br />leave and shall be permitted to use such leave with prior approval of his or her supervisor. <br /> <br />appointment may accumulate annual <br /> <br />leave.
