July 21, 2003 Page 184 <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board adopted on second reading the "Resolution <br />and Ordinance Renewing a Non-Exclusive Franchise to Mid-State Transport, <br />Inc., for the Operation and Regulation of a Non-Emergency Ambulance Service <br />within Cabarrus County, North Carolina, Pursuant to the Terms of that Certain <br />Ordinance Adopted September 4, 1990, and Constituting the Franchise Agreement <br />Referred to Therein" (set forth on Pages 155-157 of the minutes for the <br />Meeting on June 16, 2003); and approved the renewal of the non-exclusive <br />franchise agreement and authorized the County Manager to execute the <br />"Agreement for Franchise of Transportation Services for Cabarrus County Non- <br />Emergency Transportation Services" on behalf of Cabarrus County. <br /> <br />(E-2) Authorization to Award Service Weapons to Retiring Officers Gerald W. <br />Krimminger and Irene Russell <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board, pursuant to North Carolina General <br />Statute 20-187.2, declared surplus and authorized the award for the price of <br />$1.00 the service weapons to the following officers upon their retirement on <br />September 1, 2003: Gerald W. Krimminger - Smith & Wesson, 9MM, Model: 5906; <br />Serial #VJH0648; and M. Irene Russell - Smith & Wesson, 9MM, Model: 5906; <br />Serial # VAV3387. <br /> <br />(E-3) Resolution Authorizing the Exchange/Trade-In of Weapons by the Cabarrus <br />County Sheriff's Department in Securing New Weapons from Sig Arms, Inc. <br /> <br /> The Cabarrus County Sheriff's Department intends to purchase 160 Sig <br />P226 weapons during Fiscal Year 2004. The exchange/trade-in of 147 Smith & <br />Wesson 5906 weapons currently used by the department will reduce the cost of <br />the new weapon purchase. The Public Notice of Exchange/Trade-In was published <br />in THE INDEPEb-DENT TRIBUNE on June 30, 2003. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Carruth <br />and unanimously carried, the Board adopted the following Resolution <br />authorizing the exchange/trade-in of county-owned weapons. <br /> <br /> Resolution No. 2003-22 <br /> <br />STATE OF NORTH CAROLINA ) <br /> ) RESOLUTION <br />CARARRUS COUNTY ) <br /> <br />WHEREAS, Cabarrus County owns 147 Smith & Wesson 5906 (weapons) and valued at <br />$36,750 collectively; and <br /> <br />WHEREAS, Sig Arms, Inc. of New Jersey owns 160 Sig P226 (weapons) and valued <br />at $88,000 collectively; and <br /> <br />WHEREAS, the County desires to purchase 160 Sig P226 (weapons) from Sig Arms, <br />Inc. while trading-in 147 Smith & Wesson 5906 (weapons); and <br /> <br />WHEREAS, North Carolina General Statutes 143-129.7 and 160A-271 authorizes <br />the County to make such an exchange/trade-in if authorized by the Board of <br />Commissioners by a resolution adopted at a regular meeting of the board upon <br />at least 10 days' public notice; and <br /> <br />WHEREAS, the County has given the required public notice, and the board is <br />convened in a regular meeting. <br /> <br />THEREFORE, THE BOARD OF COMMISSIONERS OF CABARRUS COUNTY RESOLVES THAT: <br /> 1. The exchange/trade-in of personal property described above is <br /> authorized. <br /> 2.
