Patterson <br /> <br />Property and the Purchase of Right-of-Way across the Teresa Eudy Property to <br />Provide Access to the Patterson Property <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board authorized the County Manager and/or <br />County Attorney to enter into a contract with James E. Patterson to purchase <br />approximately 28 acres (PIN #4681-97-7698) located off NC 73 West in the <br />vicinity of Lake Howell at a purchase price of $20,000.00 per acre; and to <br />enter into a contract with Teresa Eudy to purchase a right-of-way at a cost <br />of $20,000.00 per acre to provide access from NC 73 West to the Patterson <br />Property. Further, the Board authorized the appropriate budget amendment(s) <br />for the purchase of the Patterson and Eudy properties. <br /> <br /> The Water and Sewer Authority of Cabarrus County has agreed to pay one- <br />third ($188,067.00) of the purchase price for the Patterson property. <br /> <br />(E-6) Approval of Riders to the N. C. Local Government Debt Setoff <br /> <br />Clearinghouse Program Memorandum of Understanding and Agreement to Implement <br />Recent Legislative Changes <br /> <br /> The following changes have been made to the North Carolina Local <br />Government Debt Setoff Clearinghouse Program: (1) Recent legislation permits <br />charging the debtor a $15.00 collection assistance fee, beginning January 1, <br />2003; (2) Ail debtors, including those whose debts have already been <br />submitted for processing, must be notified of collection assistance fee, and <br />notification cannot occur before January 1, 2003; (3) The clearinghouse will <br />add the $15.00 to the debt amounts submitted by participating local <br />governments; and (4) Department of Revenue now allows a county or city to <br />combine debts to meet the $50.00 minimum. <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board authorized the Chairman and County Manager <br />to execute the Local Collection Assistance Fee Rider, the Multipl~ Unit <br />Collection Rider and other required documents associated with the North <br />Carolina Local Government Debt Setoff Clearinghouse Program. These documents <br />amend the original Memorandum of Understanding and Agreement to implement the <br />recent legislative changes to the Program. <br /> <br />(E-7) Approval of the County Sheriff's Office Records Retention and <br />Disposition Schedule <br /> <br /> UPON MOTION of Commissioner Carruth, seconded by Commissioner Privette <br />and unanimously carried, the Board approved the County Sheriff's Office <br />Records Retention and Disposition Schedule as prepared by the Division of <br />Archives and History of the North Carolina Department of Cultural Resources; <br />and authorized the Chairman to sign the following ~Approval Sheet" on behalf <br />of Cabarrus County. <br /> <br />COUNTY SHERIFF'S OFFICE RECORDS RETENTION AND DISPOSITION SCHEDULE <br /> <br />The records retention and disposition schedule and retention periods <br />governing the records series listed herein are hereby approved. In <br />accordance with the provisions of Chapters 121 and 132 of the General <br />Statutes of North Carolina, it is agreed that the records do not and <br />will not have further use or value for official business, research, or <br />reference purposes after .the respective retention periods specified <br />herein and are authorized to be destroyed or otherwise disposed of by <br />the agency or official having custody of them without further <br />reference to or approval of either party to this agreement. It is <br />further agreed that these records may not be destroyed prior to the <br />time periods stated; however, for sufficient reason they may be <br />retained for longer periods.
