171 <br /> <br />emergency invOlving the health and safety of the people or their property, to <br />announce all requirements for architectural and engineering services; and <br /> <br />WHEREAS, said Act further states said architectural and engineering services <br />shall be procured from firms qualified to provide such service on the basis of <br />demonstrated competence and qualification for the type of professional services <br />without regard to the fee other than unit price information at this stage; and <br />thereafter to negotiate a contract for architectural or engineering services at <br />a fair and reasonable fee with the best qualified firm; and <br /> <br />WHEREAS, in the event that a contract cannot be negotiated with the best <br />qualified firm, negotiations with the firm shall be terminated and initiated with <br />the next best qualified firm; and <br /> <br />WHEREAS, said Model Code for Procurement of Architectural and Engineering <br />Services provides for an exemption which allows the Board of Commissioners to <br />designate a county official to negotiate and execute contracts when the estimated <br />professional fee shall be in an amount less than $30,000.00; and <br /> <br />WHEREAS, the staff of Cabarrus County has recommended that the Board of <br />Commissioners authorize such exemption and permit the Coqnty Manager to negotiate <br />and execute contracts for architectural and engineering services when said <br />project amount is less than $30,000.00; and <br /> <br />WHEREAS, the Board of Commissioners now desires to adopt provisions of said Act <br />and to further exempt projects of $30.000 or less and thereby allowing and <br />authorizing the County Manager to negotiate and execute contracts of <br />architectural and engineering services when the estimated professional fee is in <br />an amount of less than $30,000.00 <br /> <br />NOW THEREFORE BE IT RESOLVED by the Cabarrus County Board of Commissioners as <br />follows: <br />1. That the Cabarrus County Board of Commissioners does hereby adopt as the <br /> policy of Cabarrus County the provisions of The Act to provide A Model <br /> Code for Procurement of Architectural and Engineering Services by State <br /> and Local Governments as adopted and ratified by the North Carolina <br /> General Assembly in 1987 as House Bill 277. <br />2. That for those proposed projects where the estimated professional fee for <br /> architectural and engineering services is in an amount of less than <br /> $30,000.00 the County Manager is hereby authorized, as provided in said <br /> model code and act to negotiate and execute any such contracts on behalf <br /> of Cabarrus County. <br />3. BONDS~ CLERK TO THE BOARD <br /> <br />NEW BUSINESS <br /> <br />Resolution to Dissolve ~e Poplar Tent Fire Tax District -Public Hearin~ - 6:30 <br /> <br /> Mr. Mi.ke Downs, Development Services Director, presented a proposed <br />Resolution to abolish the Poplar Tent Fire Tax District effective June 30, 2002. <br />Due to annexations by the cities of Concord and Kannapolis, there are no longer <br />any parcels within the tax district that are not located within the corporate <br />limits of either. Concord or Kannapolis. No fire tax was levied in the district <br />for Fiscal Year 2001-02. Meetings will be scheduled with the fire department, the <br />North Carolina Department of Insurance and the State Fire Marshal's Office to <br />work out the future of the department. <br /> <br /> There was brief discussion regarding the status of the Poplar Tent <br />Volunteer Fire Department as a non-profit corporation, the disposition of the <br />department's assets and the structure of current fire prevention services in <br />Cabarrus County. <br /> <br /> At 7:05 p.m., Chairman Fennel opened the public hearing concerning the <br />proposed dissolution of the Poplar Tent Fire Tax District and asked if anyone <br />wished to speak regarding the proposal. The Notice of the Public Hearing was <br />published in THE CHARLOTTE OBSERVER (Cabarrus Neighbors) on August 5 and 12, <br />2001. <br /> <br /> <br />
