172 <br /> <br /> There was no one present to address the Board, and Chairman Fennel closed <br />the public hearing. <br /> <br /> UPON MOTION of Commissioner Privette, seconded by Commissioner Freeman and <br />unanimously carried, the Board adopted the following Resolution. <br /> <br />Resolution No. 2001-23 <br /> <br />RESOLUTION TO ABOLISH THE POPLAR TENT FIRE TAX DISTRICT <br /> <br /> WHEREAS, Cabarrus County, in accordance with General Statute 153A-233, <br />provides for the fire protection of its citizens by contracting with rural fire <br />departments to operate within its established fire taxing districts. <br /> WHEREAS, Cabarrus County has contracted with the Poplar Tent Volunteer Fire <br />Department to provide for the fire protection of the citizens of the Poplar Tent <br />Fire District. <br /> WHEREAS, due to recent annexations of the City of Concord and the City of <br />Kannapolis, the Poplar Tent Fire Tax District no longer has any areas that are <br />not within a corporate city limit. <br /> WHEREAS, General Statute 153A-306 states that upon finding that there is <br />no longer a need for a particular service district and that there are no <br />outstanding bonds or notes issued to finance projects in the district, the board <br />of commissioners may by resolution abolish that district. <br /> NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE <br />COUNTY OF CABARRUS, the Poplar Tent Fire Tax District be abolished and that the <br />fire protection be provided for in this area by the City of Concord and the City <br />of Kannapolis according to newly established corporate boundaries. <br /> This resolution will become effective as of this day, June 30, 2002. <br /> <br />Signed: <br /> <br />Attested: <br /> <br />/s/ Arne Fennel <br />Arne Fennel, Chairman <br />Cabarrus County Board of Commissioners <br />/s/ Frankie F. Bonds, Clerk <br />Cabarrus County Board of Commissioners <br /> <br />Zoning Text Amendment - Petition C01-01(ZT)(Table of Required Parking Spaces by <br />Use) - Public Hearing - 6:30 p.m. <br /> <br /> Ms. Kelly Sifford, Senior Planner, presented the proposed amendment to the <br />Cabarrus County Zoning Ordinance that would reduce the number .of parking spaces <br />required by churches from one per three seats to one per eight seats. She stated <br />the change would make the County's requirements the same as those in the other <br />local jurisdictions. <br /> <br /> At 7:10 p.m., Chairman Fennel opened the public hearing concerning the <br />proposed amendment to the Zoning Ordinance and asked if anyone wished to speak <br />either for or against the proposed change. The Public Hearing Notice was <br />published in THE CHARLOTTE OBSERVER (Cabarrus Neighbors) on August 9 and 12, <br />2001. <br /> <br /> There was no one present to address the Board, and Chairman Fennel closed <br />the public hearing. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Freeman and <br />unanimously carried, the Board adopted the following Ordinance. <br /> <br /> Ordinance No. 2001-08 <br />PETITION C01-01(ZT) <br /> AN ORDINANCE AMENDING THE CABARRUS COUNTY <br /> ZONING ORDINANCE <br /> <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br /> <br />Staff recommends the following change to the Cabarrus County Zoning Ordinance. <br />Section 10-6. Table of required parking spaces by use. <br /> <br />The following table sets for the number of parking spaces necessary to safely <br />accommodate vehicles anticipated by use. <br /> <br /> USE SPACES REQUIRED <br /> Churches One (1) for each eight seats <br /> <br />Adopted this the 20tn day of August, 2001 by the Cabarrus County Board of <br />Commissioners. <br /> /s/ Arne L.
