Bonds <br /> <br />Frankie Fo Bonds, Clerk to the Board <br /> <br />Amendment to the Subdivision Regulations - Petition C01-01(ST) (Certificate of <br /> <br />Water and Sewer Connection Fee Payment) - Public Hearing - 6:30 <br /> <br /> Ms. Kelly Sifford, Senior Planner, presented the proposed amendment to add <br />a Certificate of Water and Sewer Connection Fee Payment to all final plats for <br />subdivisions that receive water and sewer services from the City of Concord. <br /> <br /> At 7:14 p.m., Chairman Fennel opened the public hearing concerning the <br />proposed amendment to the Subdivision regulations and asked if anyone wished to <br />speak either for or against the proposed amendment. The Public Hearing Notice <br />was published in THE CHARLOTTE OBSERVER (Cabarrus Neighbors) on August 9 and 12, <br />2001. <br /> <br /> There was no one present to address the Board, and Chairman Fennel closed <br />the Public Hearing. <br /> <br /> UPON MOTION of Commissioner Suggs, seconded by Chairman Fennel and <br />unanimously carried, the Board adopted the following Ordinance. <br /> <br /> Ordinance No. 2001-09 <br />PETITION C01-01(ST) <br /> AN 'ORDINANCE AMENDING THE CABARRUS COUNTY <br /> CODE OF ORDINANCES <br /> <br />BE IT ORDAINED that the Code of Ordinances, Cabarrus County, N.C., is hereby <br />amended by adding a section to be numbered 66-40(b) 13 and 66-40(c) (6), which <br />section reads as follows: <br /> <br />Section 66-40(b) Final Pla~ Requirements <br />13. Ail final inspections by the public service providers must be complete and <br /> fees must be paid before the Planning Services Director will sign the <br /> Certificate of Approval by the Planning and Zoning Director. Certificate <br /> number (6) as follows in Section (c) must be affixed to all final plats where <br /> public utility services are provided by the City of Concord. <br /> <br />Section 66-40(c) Final Plat Requirements <br />6. Fennel, Chairman <br />Board of Commissioners <br /> <br />Appeal of Case C01-02(S) Denial of Preliminary Subdivision plat for Pier Protz <br />Tarrant <br /> <br /> Mr. Rodger Lentz, Senior Planner, presented the appeal of the Planning and <br />Zoning Commission's denial of Case C01-02(S), the preliminary plat for a proposed <br />subdivision located on Stallings Road near Harrisburg. The applicant (Pier Protz <br />Tarrant, Manager of LPT Investments, LLC) plans to develop 277 lots (62 <br />townhomes, 67 patio homes and 148 single-family homes) on the 82.04 acres of <br />property. The Town of Harrisburg will provide water and sewer services to the <br />subdivision pursuant to a letter dated August 9, 2001 from Mr. Doug Honeycutt, <br />Harrisburg Public Works Director. As a back up water supply in the event that <br />public water is not available, Heater Utilities has agreed to provide community <br />water service (community wells) for the subdivision. Mr. Lentz reported that the <br />only outstanding issue concerning the proposed subdivision for both staff and the <br />Planning and Zoning Commission was the issue of adequate public facilities. He <br />stated the developer has submitted a letter stating his willingness to contribute <br />$500.00 per lot towards school facilities. Finally, Mr. Lentz recommended <br />approval of the subdivision with the condition that the developer enters into a <br />consent agreement with the County to meet the adequate public facilities <br />requirements for school facilities. <br /> <br /> <br />
