He <br />explained the Board had previously approved the subdivision with the <br />exception allowing the developer to contribute to the construction of the <br />recreation area at the nearby W. W. Flowe Park in lieu of providing open <br />space within the development. Using the property previously designated for <br />open space, the developer had platted 15 additional lots. According to Mr. <br />Marshall, Mr. Wiggins has already signed a consent agreement outlining the <br />conditions placed on the subdivision, including the contribution of $500.00 <br />per lot toward school adequacy. <br /> <br /> UPON MOTION of Chairman Fennel, seconded by Commissioner Privette and <br />unanimously carried, the Board approved the preliminary plat by Randy Wiggins <br />for College Hills II Subdivision [Petition C00-06(S)] for the development of <br />15 additional lots and including the contribution of $500.00 per lot toward <br />school adequacy. <br /> <br />Preliminar~ Plat Approval for Cabarrus Farms Subdivision [C00-07(S)]- Appeal <br />by Developer T. L. Harrell Land Development Company of the Denial by the <br />Planning and Zoning Commission <br /> <br /> Mr. Marshall presented an overview of the proposed Cabarrus Farms <br />Subdivision located at the intersection of Midland Road and Bethel School <br />Road and within the proposed Midland incorporation area. There is an issue <br />concerning overcrowding at both J. N. Fries Middle School and Central <br />Cabarrus High School. The developer has reached an agreement with the Water <br />and Sewer Authority of Cabarrus County (WSACC) to advance the construction of <br />the Upper Muddy Creek Interceptor as outlined in WSACC's Capital Improvements <br />Program. The interceptor will serve the subdivision as well as the general <br />area, which includes the Bethel Elementary School replacement site and a <br />future school park site. The total proposed public benefit of the sewer <br />interceptor is estimated to be $618,000.00. Further, the developer has asked <br />that the sewer line construction be considered as a contribution towards <br />adequacy of public facilities and that a recreation area not be required <br />within the subdivision. Letters were included in the agenda package from <br />WSACC and the County Schools relative to the sewer line construction and the <br />benefit to the schools. The Schools have estimated that the sewer line <br />construction could save the County as much as $900,000.00. <br /> <br /> Mr. Mike Rackley of T. L. Harrell Development Company was present to <br />respond to any questions by the Board. A letter dated September 29, 2000 from <br />Mr. Rackley outlined the proposal for construction of the sewer interceptor. <br /> <br /> <br />
