145 <br /> <br />5. Major developments must include an effort to retain mature <br /> trees. Existing trees of 12 inch diameter at breast height <br /> (dbh) or greater must be identified and shall not be removed <br /> except when buildings, roads or required utilities are to be <br /> constructed. <br />6. All new roads shall be constructed to NCDOT standards as <br /> prescribed in the Cabarrus County Subdivision Regulations. <br /> The Rimertown community shall not be responsible for the <br /> maintenance of these roads. A homeowners association or the <br /> property developer shall be responsible for maintaining the <br /> roads to NCDOT standards until such time as they are accepted <br /> for public maintenance. <br /> <br />Section 4-42. Appeals and exceptions. <br />Where a person, or persons, proposing a major development feels they <br />are not able to meet the requirements of this overlay zone, they may <br />appeal to the County Planning and Zoning Commission acting as a Board of <br />Adjustment.
