245 <br /> <br /> Chairman Carpenter opened the public hearing for the 1993 CDBG program and <br />asked if anyone were present who wished to speak regarding this program. There <br />was no one present to address the Board, and Chairman Carpenter closed the public <br />hearing. <br /> <br /> Mr. Stark reported that there were two possible project areas, Troutman <br />Road and Midland, for the 1993 CDBG program. He asked for the Board's direction <br />in preparing the 1993 grant application. The Board by consensus delayed a <br />decision in this matter until April 19. <br /> <br />Community Development Block Grant - Howell Center Project A. Sewer Connection Charges <br /> B. Water Connection Charges <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Chairman Carpenter and <br />unanimously carried, the Board approved the following Sewer Connection Charges <br />and Water Connection Charges for the Howell Center Community Development Block <br />Grant Project. <br /> CABARRUS COUNTY UTILITY DEPARTMENT <br /> SEWER CONNECTION CHARGES <br /> FOR THE <br /> HOWELL CENTER CDBG SEWER LINES <br /> <br /> WHEREAS, the County of Cabarrus seeks to provide sanitary sewer to all <br />County citizens and businesses, and <br /> WHEREAS, the County of Cabarrus has applied for funding for the <br />installation of a sewer system to serve the Howell Center off Hwy 24-27 in <br />Midland using Community Development block Grant funds, and <br /> WHEREAS, the funding source, the North Carolina Commerce Finance Center <br />requires a recapture plan of grant monies from connections to the sewer lines; <br /> NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the County <br />of Cabarrus, that: <br /> Section I: Future users connecting to the sewer extension funded through <br />the CDBG-ED who have not participated financially in the construction of the <br />extension shall be required to pay an assessment fee of $500.00 per acre to <br />Cabarrus County. This fee is in addition to normal tap fees and shall be paid <br />in full prior to connection to the sewer lines and will be reviewed from time to <br />time as appropriate. <br /> Section II: The assessment fee required in Section I shall not be imposed <br />on any business that is owned by low and moderate-income persons, any business <br />whose employees total at least 51% low- and moderate-income persons, or any <br />residence that is owned and occupied by low- and moderate-income persons. <br /> Section III: In the event a person who owns acreage with a home wants to <br />connect to the line the assessment fee will be $500.00 for the home only. In the <br />event the property is developed further the $500.00 per acre fee will be in <br />effect. <br /> Section IV: Cabarrus County reserves the right to reduce the assessment <br />fee charged to future users based upon the user's economic impact on the County's <br />overall economy and with the concurrence of the Commerce Finance Center. <br /> Section V: Ail revenue generated by this assessment policy prior to <br />completion of the project shall be used to reduce the amount of the CDBG-ED <br />grant. Fifty percent (50%) of all revenue generated by the assessment policy <br />thereafter shall, for a period of five (5) years, be returned to the Economic <br />Development Fund at the Commerce Finance Center for the funding of future <br />Economic Development Projects. The fifty percent (50%) retained by the County <br />shall be used to finance future capital improvements to the County's sewer system <br />with priority placed upon improvements to benefit low- and moderate-income <br />persons. <br /> Adopted this 5th day of April, 1993. <br /> /s/ Carolyn Carpenter <br /> Carolyn Carpenter, Chairman <br /> Cabarrus County <br /> Board of Commissioners <br /> <br />/s/ Frankie F.
