285 <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Casper and <br />unanimously carried, the Board awarded the contract for the purchase of a <br />remittance processor for the Tax Collector's office to the low bidder, Compusist, <br />Inc., in the amount of $49,007.00. <br /> <br />Road Name Change Public Hearing - 7;00 P.M, <br /> <br /> At 8:30 P.M., Chairman Carpenter stated that this was the date and hour for <br />a public hearing to consider the naming of an unnamed road (Petition 92-93/07) <br />as Sapp Dale Drive. She asked if anyone were present to speak for or against the <br />proposed road name. There was no one present to address the Board, and Chairman <br />Carpenter closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the naming of an Unnamed Road (Petition <br />92-93/07) as Sapp Dale Drive. <br /> <br />Zoning Atlas Amendments - Public Hearing - 7:00 P.M. <br /> <br /> At 8:30 P.M., Chairman Carpenter stated that this was the date and hour for <br />a public hearing on proposed Zoning Atlas amendments. <br /> <br />Petition 93-02. Phil Cline, Petitioner. Located on Highway 49. <br />Map/PIN 5539-43-1339 and 5539-42-2392. Wish to rezone from R-15 to <br />I-1/su. <br /> <br />Planning and Zoning Commission voted 8-1 to approve with the added <br />condition of a two-hundred foot buffer from all points in Windrose <br />Subdivision. <br /> <br /> Mr. Eddie Moose, Vice-Chairman of the Cabarrus County Planning and Zoning <br />Commission, presented Petition 93-02 by Phil Cline as approved by the Planning <br />and Zoning Commission to rezone approximately 45 acres on Highway 49 from R-15 <br />to I-i(SU). <br /> <br /> Mr. Gerald A. Newton, Director of Planning, Zoning and Building <br />Inspections, pointed out the petitioner had requested the rezoning in an attempt <br />to move the trucking operation away from the residents of the Windrose community. <br /> <br /> Ms. Sue Russell, Planner, reviewed the location of the property and <br />presented a map showing the area zoning relationshiBs. She presented the staff <br />analysis recommending approval with restrictions as agreed to by the petitioner. <br />Ms. Russell outlined the following facts regarding the proposed rezoning: 1) <br />Current R-15 zoning is not correct for roadway corridor such as Highway 49; 2) <br />Proposed I-1 (SU) rezoning includes 13 permitted uses and one accessory use with <br />a 100-foot buffer around the property with a 200-foot buffer about all points of <br />property known as Windrose. The Harrisburg Area Land Use Plan projects the <br />future use of the property as high density residential; however, the topography <br />of the property, flood plain, and sewer rights-of-way make it impossible to use <br />the property as residential. As a substitute, the I-1 use is reasonable and <br />meets the intent of the Plan. 3) Property will be developed in two phases with <br />Phase I consisting of approximately 6 acres and Phase II of approximately 14 <br />acres. The remaining property will be left in its natural state. 4) <br />Recommendations concerning traffic improvements (center turn lane, deceleration <br />lane and site access) will be referred to the Department of Transportation for <br />evaluation and final determination. 5) Mitigating circumstances concerning the <br />residentially zoned and used property adjoining the property proposed for <br />rezoning include: a) Petitioner has agreed to a permanent vegetative buffer; b) <br />Acquisition of rezoned property will enable petitioner to move operation away <br />from the border currently shared with residential use; and c) Zone proposed is <br />a limited industrial zone with less than one-fifth of the normal uses allowed. <br /> <br /> Mr. Fletcher L. Hartsell, Jr., County Attorney, affirmed Mr. Gordon Belo <br />and Mr. Jonathan Loeb who indicated they wished to address the Board during the <br />public hearing. <br /> <br /> Chairman Carpenter opened the public hearing for Petition 93-02 by Phil W. <br />Cline and asked if anyone were present who wished to speak for or against the <br />proposed rezoning. <br /> <br /> <br />
