286 <br /> <br /> Mr. Gordon Belo, Attorney representing Phil Cline (petitioner) and John and <br />Ora Pharr (property owners), spoke in support of the rezoning request. He stated <br />that Mr. Pharr had been unable to market the property as residential due to its <br />being bottomland and its location on Highway 49. Mr. Belo stated that the <br />additional property will enable the trucking company to move the trucks around <br />more easily as they are brought in for refueling and for switching cabs. <br /> <br /> Mr. Jonathan Loeb of 1328 Rosehill Court stated that he was generally <br />opposed to the rezontng but did appreciate the agreement to add the 200-foot <br />buffer. He stated in his opinion that a high residential area abutting an <br />industrial area is not consistent with the Harrisburg Land Use Plan for that <br />area. <br /> <br /> There was no one else present to address the Board regarding Petition 93- <br />02, and Chairman Carpenter closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved Petition 93-02 by Phil Cline, petitioner, <br />to rezone property on Highway 49, as recommended by the Planning and Zoning <br />Commission and staff and as set forth below: <br /> <br />1) <br /> <br />Rezone parcels #5539-43-1339 and 5539-42-2392 from their <br />current zoning designations of R-15 to I-l, Special Use with <br />uses restricted to: <br />Permitted: Agricultural Uses, Clothing & textile <br />manufacture; Dairy processing and distribution; Electric <br />supply and equipment manufacture; ~Farm machinery <br />assembly, repair and sales; Freezer, locker and ice <br />plants; Nursery, greenhouse and truck garden; Offices, <br />administrative; Offices, professional; Off-street <br />parking; Truck and Trailer rental; Trucking terminal; <br />Warehousing. <br /> <br />Accessory - On premise sign (further regulated elsewhere <br />in the Ordinance). <br /> <br />2) <br /> <br />In conjunction with the above rezoning, file a Certificate of Land <br />Use Restriction (CLUR) with the Register of Deeds for Cabarrus <br />County based on site plan improvements committing to the following: <br /> <br />a) <br /> <br />A lO0-foot natural vegetative buffer to be kept in <br />perpetuity about the perimeter of the property with an <br />increase to 200 feet from all points in Windrose <br />Subdivision as shown on a development plan dated <br />February 9, 1993 prepared by Piedmont Real Estate <br />Service. <br /> <br />3) <br /> <br />Refer all recommendations for traffic improvements to the <br />North Carolina Department of Transportation for evaluation and <br />final determination. <br /> <br /> The Certificate of Land Use Restriction is filed in the Office of the <br />Register of Deeds and is hereby included by reference as a part of the minutes. <br /> <br />Petition 93-03. Sylvia Skelly, Petitioner. Located on N.C. Highway <br />24/27 near U.S. 601, less than one acre. Map/PIN 5554-09-4618. Wish <br />to rezone from ARR to O-I. Planning and Zoning Commission voted 9-0 <br />to approve this rezoning request. <br /> <br /> Mr. Moose presented Petition 93-03 and the recommendation of the Planning <br />and Zoning Commission to approve the rezoning request. Mr. Jonathan Marshall, <br />Planning staff member, presented the Staff Analysis which also recommended <br />approval. He noted that rezoning is supported by the future land use projections <br />of the Midland Area Plan, by current development and development trends, and by <br />required/available infrastructure. <br /> <br /> <br />
