287 <br /> <br /> Chairman Carpenter opened the public hearing for Petition 93-03 and asked <br />if anyone were present who wished to speak either for or against the proposed <br />rezoning. There was no one present to address the Board, and Chairman Carpenter <br />closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Chairman Carpenter and <br />unanimously carried, the Board approved Petition 93-03 by Sylvia Skelly, <br />petitioner, rezone property on N.C. Highway 24/27 near U.S. 601, Map/PIN 5554-09- <br />4618, from ARR to O-I. <br /> <br />Request for the Board to Join in the Opposition to the Frequency Change for Fire <br />Service and other EMS Organizations by the Federal Communications Commission <br />Ben Mabrey, Emergency Management Director <br /> <br /> Mr. Ben Mabrey, Emergency Management Director, reported that the Federal <br />Communications Commission was presently considering a rule change to narrow the <br />frequency band width in 1996 and again in the year 2000 to 2003. This change <br />would necessitate costly radio modifications and replacements for public safety <br />agencies as well as for the numerous volunteer fire departments and rescue <br />operations. Mr. Mabrey requested that the Board join the Fire Chief's Association <br />and Regional Emergency Medical Services Advisory Commission in opposing this <br />change. <br /> <br /> UPON MOTION of Commissioner Casper, seconded by Commissioner Barnhart and <br />unanimously carried, the Board instructed the County Manager to write a letter <br />to the Federal Communications Commission stating the Board's opposition to the <br />proposed rule change to narrow the frequency band width due to the unfair burden <br />such a change would place on counties such as Cabarrus. <br /> <br />Request for a Change to the Military Leave Section of the Cabarrus County <br />Personnel Ordinance <br /> <br /> Mr. Don Moorhead, Personnel Officer, presented a proposed amendment to the <br />County's Personnel Ordinance for the County to pay full County compensation in <br />addition to military pay due to employees during the up to ten days of military <br />leave each year. <br /> <br /> UPON MOTION of Commissioner Fennel, seconded by Commissioner Barnhart with <br />Commissioners Fennel, Barnhart and Casper and Chairman Carpenter voting for and <br />Commissioner Payne voting against, the Board moved to leave the current military <br />leave section of the Personnel Ordinance in place with the addition of "non- <br />monetary" to the second to last sentence in the section. The amendment as <br />approved on first reading by the Board was as follows. <br /> <br />ARTICLE VI Leaves of Absence <br /> <br />Section 26, Military Leave <br /> <br /> Permanent employees who are members of the National Guard or <br />Armed Forces Reserve will be allowed (10) workdays per year military <br />training leave. If the compensation received while on military <br />leave is less than the salary that would have been earned during <br />this same period as a County employee, the employee shall receive <br />partial compensation equal to the difference in the base salary <br />earned as a reservist or guardsman and the salary that would have <br />been earned during this same period as a County employee. The <br />effect will be to maintain the employee's salary at the normal level <br />during this period. If this military duty is required beyond this <br />ten (10) workday period, the employee shall be eligible to take <br />accumulated annual leave, or be placed in a leave-without-pay <br />status. Reservists called to active duty, with no training period <br />preceding the active duty, shall be allowed to charge up to ten days <br />per year of active duty as military training and receive pay for <br />these days. <br /> While taking miliary leave with partial pay or without pay, <br />the employee's leave credits and other ~2on-monetary benefits shall <br />continue to accrue as if the employee physically remained with the <br />County during this period. Regular employees who are guardsmen and <br />reservists have all job rights specified in the Veterans <br />Readjustment Assistance Act. <br /> <br /> <br />
