406 <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Carpenter and <br />unanimously carried, the Board postponed that part of the Animal Gontrol <br />Ordinance regarding the implementation of the licensing of dogs and cats until <br />January 1, 1994. The Board further asked Mr. Witherspoon to present a report at <br />the first meeting in November regarding a plan as to how the County may do the <br />licensing in-house. <br /> <br />Zoning Atlas Amendments - North Central Area Plan - Public Hearing - 7;00 P,M, <br /> <br /> At 8:30 P.M. Chairman Carpenter stated that this was the date and time for <br />a public hearing relative to proposed Zoning Atlas Amendments and the North <br />Central Area Plan. <br /> <br />Petition 93-05. Melvin and Ruby Bailey, owners. Located off <br />Berwick Court, Map/PIN 5600-68-2972, 3.2 acres, wish to rezone from <br />R-40 to ARR/Special Use to construct an auto repair garage. The <br />Planning and Zoning Commission voted 6 2 to recommend denial of <br />this petition. <br /> <br /> Dr. Nancy Randall, Chairman of the Planning and Zoning Commission, <br />presented the Commission's recommendation to deny the petition. She explained <br />that the proposed rezoning would not be in compliance with the Western Area Plan. <br />In addition, Dr. Randall pointed out that the auto repair garage would be a <br />conditional use in the ARR zone. <br /> <br /> Mr. Jonathan Marshall, Planning staff member, presented the concept plan <br />for the property as submitted by Mr. Bailey. He also reviewed the staff analysis <br />recommending approval of the petition with the following conditions: <br /> <br />That areas between the proposed garage and any existing or <br />future residential areas be screened. <br />That all parking areas be landscaped and screened from view of <br />adjacent residential areas. <br />That no wrecked or salvaged vehicles be stored on the <br />property. <br /> <br />Mr. Marshall reported that there are two businesses immediately adjacent to the <br />property and that the proposed use would be in compliance with existing <br />commercial and residential uses if it is properly screened. <br /> <br /> Mr. Hartsell and Mrs. Bonds affirmed Mr. Melvin Bailey who indicated he <br />wished to speak during the public hearing on Petition 93-05. <br /> <br /> Chairman Carpenter opened the public hearing for Petition 93-05 and asked <br />is anyone wished to speak either for or against the proposed rezoning. <br /> <br /> Mr. Melvin Bailey, petitioner, spoke in support of the rezontng. He stated <br />that he had owned the property for 35 years and that there were no objections by <br />adjacent property owners to the requested rezoning. <br /> <br /> There was no one else present to speak regarding Petition 93-05, and <br />Chairman Carpenter closed the public hearing. <br /> <br /> Upon questioning, Mr. Bailey agreed to the conditions as presented by Mr. <br />Marshall and listed above. Mr. Hartsell clarified with Mr. Marshall that the <br />condition regarding the storage of wrecked or salvaged vehicles on the property <br />related to "outside" storage. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved Petition 93-05 by Melvin and Ruby Bailey <br />to rezone property off Berwick Court, Map/PIN 5600-68-2972, 3.2 acres, from R-40 <br />to ARR/Special Use to construct an auto repair garage with the following <br />conditions as recommended by the Planning, Zoning and Building Inspection <br />Department. <br /> <br />That areas between the .proposed garage and any existing or <br />future residential areas be screened. <br />That all parking areas be landscaped and screened from view of <br />adjacent residential areas. <br /> <br /> <br />
