461 <br /> <br /> There was no one else present to address the Board, and Chairman Carpenter <br />closed the public hearing on Petition 93-10. <br /> <br /> Chairman Carpenter asked to be excused from voting as the company she works <br />for does business with Mr. Wickens. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Fennel and <br />unanimously carried, the Board excused Chairman Carpenter from voting in the <br />matter of Petition 93-10. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Fennel with <br />Commissioners Barnhart, Fennel, Casper and Payne voting for and Chairman <br />Carpenter abstaining, the Board approved Petition 93-10 by J. A. and Patti <br />Fisher, owner, and Brian F. S. Wickens, petitioner, to rezone property on Poplar <br />Tent Road near Rock Hill Church Road, PIN 5610-18-6865 and 18-7864, from R-30 to <br />C-3 Special Use with the following conditions: <br /> <br />(~) <br /> <br />(2) <br /> <br />(3) <br /> <br />That the automobile repair garage be limited to automobiles, <br />vans, and light trucks repair (no heavy trucks); <br />That the natural vegetative screening will be provided from 50 <br />feet on the east side of the property from the right-of-way 50 <br />feet back and from that point the six-foot wooden fence shown <br />on the drawing submitted with the petition is equal to the <br />back of the asphalt paving; and <br />That there will be no Sunday operation of the business until <br />after 1:00 P.M. <br /> <br />The development concept plan for the property is on file with the Planning, <br />Zoning, and Building Inspection Department and the Certificate of Land Use <br />Restriction is filed with the Register of Deeds. <br /> <br />Mobile Home Park Ordinance - Public Hearing - 7:00 P.M, <br /> <br /> Dr. Randall presented the revised Mobile Home Park Ordinance as unanimously <br />approved by the Planning and Zoning Commission. <br /> <br /> Mr. Joey Untz briefly outlined the major issues which had been addressed <br />in the new ordinance. These items included revised standards for Class I and <br />Class II mobile homes, interior streets within a park, and walkways. <br /> <br /> Chairman Carpenter opened the public hearing concerning the proposed Mobile <br />Home Park Ordinance and asked if anyone were present who wished to speak either <br />for or against the ordinance. <br /> <br /> There was no one present to address the Board, and Chairman Carpenter <br />closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Casper and <br />unanimously carried, the Board adopted the Mobile Home Park Ordinance as <br />recommended by the Planning and Zoning Commission. The Ordinance as approved is <br />as follows. <br /> <br /> CABARRUS COUNTY <br />MOBILE HOME PARK ORDINANCE <br /> <br />Regulations Governing Mobile Home Parks: <br />The purpose of this ordinance is to regulate and guide the establishment of <br />mobile home parks in order to promote the public's health, safety, and general <br />welfare of the citizens of Cabarrus County, North Carolina. This ordinance is <br />designed to accomplish the following specific objectives: <br /> <br />(1) <br />(2) <br />(3) <br />(4) <br /> <br />to further the orderly layout of mobile home parks, <br />to secure safety from fire, panic, and other damages, <br />to provide adequate light and air, <br />to insure that facilities for transportation, parking, water, <br />sewage and recreation are provided for mobile home park <br />residents. <br /> <br /> <br />
