Bonds <br /> <br />Clerk <br /> <br />BOARD OF COMMISSIONERS <br />OF CABARRUS COUNTY <br />By: /s/ Jeffrey L, <br /> Chairman <br /> <br />Barnhart <br /> <br />Property Exchange with the Water and Sewer Authority <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Casper and <br />unanimously carried, the Board adopted the following Agreement of Intent. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />AGREEMENT OF INTENT FOR THE <br />EXCHANGE OF PROPERTy INTERESTS <br /> <br /> THIS AGREEMENT OF INTENT (hereinafter referred to as the <br />"Agreement"), made and entered into as of the latter of the dates of <br />approval of the governing boards set forth herein, by and between <br />CABARRUS COUNTY, a body politic and political subdivision of the <br />State of North Carolina (hereinafter referred to as "County"), and <br />the WATER AND SEWER AUTHORITY OF CABARRUS COUNTY, a public <br />corporation of the State of North Carolina (hereinafter referred to <br />as the "WSACC"); <br /> <br />W I T N E S S E T H: that -- <br /> <br /> WHEREAS, the County is required to comply with wetlands <br />mitigation mandates from the State and Federal governments regarding <br />the construction of the Coddle Creek Reservoir; and <br /> WHEREAS, when the Environmental Protection Agency approves <br />transfer of the original grants, under the terms of an agreement <br />between the County and the City of Concord, Concord will transfer <br />all property at the Rocky River Regional Wastewater Treatment Plant <br />(the "RRRWWTP:") to the WSACC; and <br /> WHEREAS, a portion of the RRRWWTP is located in the Irish <br />Buffalo Creek flood plain and cannot be used for Plant expansion, <br />but is suitable for wetlands mitigation; and <br /> WHEREAS, the WSACC requires additional office space, and the <br />County has a limited amount of space available in the County's <br />Utilities Building located at 2326 Davidson Highway (Highway 73 <br />West) (the "Utilities Building"); and <br /> WHEREAS, the staffs of the County Utilities Department and <br />WSAGC frequently work closely together, and staff cooperation and <br />the coordination of facilities between the County and the WSACC will <br />serve the interests of the citizens of Cabarrus County and the <br />greater utility service area; <br /> <br /> NOW, THEREFORE, in consideration of mutual promises and <br />covenants contained herein, the County and the WSACC do hereby agree <br />as follows: <br /> <br />AGREEMENT <br /> <br /> 1. Mitigation Site: In exchange for a lease of <br />approximately 1100 square feet of designated space in the Utilities <br />Building, the WSACC agrees to transfer to the County those ~17 acres <br />of the RRRWWTP in the flood plain adjacent to Irish Buffalo Creek, <br /> <br /> <br />
