479 <br /> <br /> generally described in Exhibit A attached hereto, for mitigation for <br /> the Coddle Creek Reservoir (the "Mitigation Site"), subject to three <br /> (3) rights-of-way as shown on Exhibit A. The respective rights-of- <br /> way are a 60-foot right-of-way for the electrical power line to be <br /> granted to the City of Concord, a 30-foot right-of-way parallel to <br /> and adjacent to the power line right-of-way for a future sewer line, <br /> and a lO0-foot right-of-way along Rocky River for future <br /> construction of an effluent outfall line to the confluence of Rocky <br /> River and Irish Buffalo Creek. <br /> 2. Office Space. In exchange for the transfer of the <br /> Mitigation Site, the County agrees to lease to the WSACC <br /> approximately 1100 square feet of designated space, including <br /> utilities, in the Utilities Building, as set forth generally on <br /> Exhibit B, together with routine use of common areas, restrooms, <br /> conference rooms, break/lunch rooms and parking areas. <br /> 3. Lease Term, Option to Extend, and Rights of First <br /> Refusal. The initial term of the lease of the designated space in <br /> the Utilities Building shall be ten (10) years, commencing January <br /> 1, 1994, for which the County shall have received the Mitigation <br /> Site as rental compensation. In addition, the County shall grant to <br /> the WSACC an option to lease the designated space for a subsequent <br /> term of ten (10) years at a rate to be agreed upon by the parties <br /> six (6) months prior to the expiration of the original term. <br /> Finally, the County shall grant to the WSACC a right of first <br /> refusal to purchase the Utilities Building and to repurchase the <br />· Mitigation Site. <br /> County and WSACC mutually agree that the value of the <br /> Mitigation Site and the value of the lease for the initial term, <br /> with the option right and rights of first refusal is approximately <br /> Eighty-Five Thousand Dollars ($85,000.00). <br /> 4. Finalization of Agreements.
