445 <br /> <br />WHEREAS, the purpose of these transportation funds is to provide <br />grant monies to local agencies for the provision of rural public <br />transportation services; and <br /> <br />WHEREAS, Article 2B of Chapter 136 of the North Carolina General <br />Statutes and the Governor of North Carolina have designated the <br />North Carolina Department of Transportation (NCDOT) as the agency <br />responsible for administering funds received through Section 18 of <br />the Urban Mass Transportation Act of 1964; and <br /> <br />WHEREAS, Cabarrus County, hereby assures and certifies that it will <br />comply with the Federal Statutes, regulations, executive orders, the <br />Special Section 13(c) Warranty, and all administrative requirements <br />which relate to the applications made to and grants received from <br />the Urban Mass Transportation Administration, as well as the <br />provisions of Section 1001 of Title 18, U.S.C. <br /> <br />NOW, THEREFORE, be it resolved that the Chairman of the Cabarrus~ <br />County Board of Commissioners is hereby authorized to submit a grant <br />application for funding under Section 18 of the Urban Mass <br />Transportation Act of 1964, make the necessary assurances and <br />certifications and be empowered to enter into an agreement with the <br />NCDOT to provide rural public transportation services. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby with <br />Commissioners Payne, Hamby, and Barnhart and Chairman Carpenter voting for, the <br />Board deferred the appointments to the Nursing Home Community Advisory Committee <br />and the Domiciliary Home Community Advisory Committee until the next meeting. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Hamby with <br />Commissioners Barnhart, Hamby, and Payne and Chairman Carpenter voting for, the <br />minutes of December 16, 1991, were approved as written. <br /> Chairman Carpenter recessed the meeting until the conclusion of the <br />meeting of the Water and Sewer District. <br /> Chairman Carpenter reconvened the meeting of the Board of County <br />Commissioners. <br /> Without objections and by consent, the Board agreed to add to the agenda <br />the Amendment No. 2 to the Settlement Agreement between the City of Concord and <br />Cabarrus County. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Hamby with <br />Commissioners Barnhart, Hamby, and Payne and Chairman Carpenter voting for, the <br />Board accepted the following Amendment No. 2 to the Settlement Agreement and <br />authorized Chairman Carpenter to execute the Amendment on behalf of Cabarrus <br />County. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />Amendment to Contract <br /> Date Approved by BOC <br /> <br /> AMENDMENT NO. 2 <br /> TO <br />SETTLEMENT AGREEMENT <br /> <br />1/21/92 <br /> <br /> THIS AMENDMENT NO. 2 TO SETTLEMENT AGREEMENT, made and entered into as of <br />the 21st day of January, 1992, by and between the CITY OF CONCORD, a municipal <br />corporation (hereinafter referred to as "Concord"), and CABARRUS COUNTY, a <br />political subdivision of the State of North Carolina (hereinafter referred to <br />as "Cabarrus County"); <br /> W I T N E S S E T H: that -- <br /> WHEREAS, effective January 6, 1992, Concord and Cabarrus County entered <br />into a Settlement Agreement resolving certain disputes and differences between <br />them; and <br /> WHEREAS, Subparagraph 7(a) of the Settlement Agreement provides that <br />"within fifteen (15) calendar days of the execution of this (Settlement) <br />Agreement, Concord and Cabarrus County shall rescind the Water and Sewer <br />Contract dated November 30, 1990 (relating to the construction and maintenance <br />of Water and Sewer lines to that area of Cabarrus County commonly known as <br />"Kings Grant") by documentation satisfactory to ~counsel for Concord and Cabarrus <br />County, "; anal <br /> <br /> <br />
