479 <br /> <br /> WHEREAS, by action of August 19, 1991, and Resolution of <br />September 2, 1991, the Board of Commissioners of Cabarrus County did <br />call upon the Cabarrus County Board of Elections to conduct the <br />election described in the Act in the Poplar Tent Beautification <br />District on November 5, 1991; and <br /> <br /> WHEREAS, the Cabarrus County Board of Elections did conduct <br />the election described in the Act on November 5, 1991, and certified <br />the election results of said referendum to the Board of <br />Commissioners of Cabarrus County wherein a majority of the qualified <br />voters voting in the election voted in favor of creating the Ppplar <br />Tent Beautification District; and <br /> <br /> WHEREAS, the Board of Commissioners of Cabarrus County finds <br />that: <br /> 1. There is a demonstrable need for creating the Poplar Tent <br />Beautification District to beautify the District and to protect the <br />citizens of the District by developing and implementing a <br />beautification plan providing for the installation of underground <br />utility lines and facilities, the development of buffering, <br />landscaping design, and other appearance requirements, and other <br />beautification or infrastructure improvement projects, including <br />sidewalks, bike paths, and greenways. <br /> 2. The residents of the area and territory to be included in <br />the Poplar Tent Beautification District will benefit from the <br />District's creation. <br /> 3. It is economically feasible to provide the identified <br />services in the Poplar Tent Beautification District without <br />unreasonable or burdensome annual tax levies. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners <br />of Cabarrus County that: <br /> 1. The Poplar Tent Beautification District be and the same <br />is hereby created and established. <br /> 2. The Clerk of the Cabarrus County Board of Commissioners <br />shall file a copy of this Resolution with the Clerk of Superior <br />Court for Cabarrus County, North Carolina, and shall certify a copy <br />thereof and deliver a copy thereto to the City of Concord, North <br />Carolina. <br /> Adopted this 9th day of March, 1992. <br /> <br />CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />By: /s/ Carolyn Bo Carpenter <br /> Carolyn B. Bonds <br />Clerk <br /> <br />INFORMAL PUBLIC COMMENTS <br /> <br /> Chairman Carpenter opened the meeting for informal public comments at 9:10 <br />P.M. <br /> Mr. Ken Olio-Mills complained that Vision Cable of Metrolina had not <br />fulfilled the requirements of the cable television franchise ordinance. He <br />stated the company had failed to submit an annual report, to maintain a <br />complaint log, and to submit certified quarterly reports with its franchise <br />payments. Also, he asked that the company be required to itemize its monthly <br />bills and that the County increase the franchise fee from three percent (3%) to <br />five percent (5%). In conclusion, Mr. Olio-Mills requested that the County <br />appoint a task force to work the County and Vision Cable in drafting a renewal <br />of the franchise ordinance. <br /> Chairman Carpenter stated that the Board would consider the information <br />presented by Mr. Olio-Mills. <br /> <br /> <br />
