512 <br /> <br />INFORMAL PUBLIC COMMENTS <br /> <br /> Chairman Carpenter opened the meeting for informal public comments at 8:10 <br />P.M. <br /> Mr. Tony Bonds, farmer and gravel truck operator, spoke against a proposed <br />Ordinance Requiring Covering of Loads on Vehicles. He called the Board's <br />attention to North Carolina General Statutes 20-116(g) regarding the hauling of <br />loads on State roads and questioned the enforcement of the proposed County <br />ordinance. <br /> Chairman Carpenter stated that the Board would take the comments by Mr. <br />Bonds into consideration in reviewing the proposed ordinance. <br /> There was no one else present who wished to address the Board, and <br />Chairman Carpenter closed the public comments portion of the meeting at 8:15 <br />P.M. <br /> <br />OTHER BUSINESS <br /> <br /> Commissioner Payne challenged all Board members to sponsor Mr. Witherspoon <br />and other walkers in the upcoming March of Dimes WalkAmerica on April 25. <br />Chairman Carpenter also encouraged every one to participate in WalkAmerica. <br /> The Board agreed to meet at 5:30 P.M. on Monday, April 13, to continue <br />review of the proposed Five-Year Strategic Plan for the County. Chairman <br />Carpenter thanked Commissioners Barnhart and Simmons for their work in preparing <br />the proposed Plan. <br /> There was no objection to Mr. Hartsell's request to add items to the <br />agenda regarding a contract for the relocation of telephone lines in the Coddle <br />Creek Reservoir area and the finalization of two property acquisitions in the <br />Reservoir project area. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart with <br />Commissioners Payne, Barnhart and Hamby and Chairman Carpenter voting for, the <br />Board authorized the Chairman to execute the Agreement between the Concord <br />Telephone Company and Cabarrus County for the relocation of telephone lines in <br />Coddle Creek Reservoir area with the stipulation that any work over the <br />estimated cost of $182,932.69 be brought back to the Board for approval. The <br />agreement as approved was as follows: <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br /> THIS AGREEMENT, made and entered into this 6th day of April, <br />1992, by and between CABARRUS COUNTY, a political subdivision of the <br />State of North Carolina, hereinafter referred to as "CABARRUS"; and <br />THE CONCORD TELEPHONE COMPANY, a North Carolina Corporation, <br />hereinafter referred to as "CONCORD"; <br /> RECITALS <br /> Cabarrus is in the process of constructing a reservoir known <br />as "CODDLE CREEK RESERVOIR" and the water in said reservoir will <br />cover a part of Highway 73, North, presently existing, said Highway <br />to be relocated, and it is necessary that the telephone utility <br />lines located along said portion of Highway 73, North, be relocated <br />and Cabarrus has requested that Concord relocate said lines and <br />Concord has agreed to do so upon the payment by Cabarrus of the cost <br />of relocation; <br /> In consideration of the recitals and the agreements herein <br />made, Cabarrus and Concord do agree as follows: <br /> 1. That Concord will relocate the telephone lines along <br />Highway 73, North, which will be covered by the water in the Coddle <br />Creek reservoir by installing new telephone lines along the new <br />portion of Highway 73, North, for a distance of approximately 4,475 <br />feet, said relocation to extend from Project Station 14 to Project <br />Station 58 as shown on the map attached hereto and marked "Exhibit <br />A". The work will be done in accordance with the plans attached <br />hereto marked "Concord Telephone Company, Job No. OD92-1002, dated <br />3-2-92" consisting of 9 sheets, numbered 1 through 9. No new <br />rights-of-way will be required, but an Encroachment Permit from the <br />Department of Transportation will be required. <br /> <br /> <br />
