At large members shall reside in areas not <br />served by cable at the time of their appointment. After the initial <br />term, appointments shall be for a three (3) year term. If <br />reappointed by the Board, a member may serve up to two (2) <br />consecutive terms subsequent to the initial term. <br /> 2. Powers and Duties. Upon formation, the Commission may <br />undertake the following powers and duties: <br /> (a) Elect officers and enact by-laws regarding the <br />organization and activities of the Commission consistent with the <br />Ordinance. <br /> (b) Advise the Board on applications for franchises, unless <br />the Board shall otherwise provide for the handling of this function. <br /> (c) Advise the Board on matters which might constitute <br />grounds for revocation of any cable franchise in accordance with the <br />Ordinance or any successor cable franchise ordinance. <br /> (d) Resolve disagreements among franchisees, subscribers and <br />public and private users of the system, decisions regarding which <br />shall be appealable to the Board. <br /> (e) Require an audit of all franchisee records required by <br />the Ordinance and, in its discretion, require the preparation and <br />filing of information additional to that required herein. <br /> (f) Make an annual report to the Board, which shall include: <br />an account of franchise fees received and distributed, the total <br />number of hours of utilization of public channels, and hourly <br />subtotals for various programming categories, and a review of any <br />plans submitted during the year by franchisee(s) for development of <br />new services. <br /> (g) Conduct evaluation of the system at least every five (5) <br />years with the franchisee, and pursuant thereto, make <br />recommendations to the Board for amendments to the Ordinance or the <br />franchise agreement. <br /> (h) Evaluate the performance of a franchisee who has <br />requested franchise renewal, if requested to do so by the Board. <br /> (i) Make periodic assessments of complaints regarding all <br />aspects of cable service and report the findings of such assessments <br />to the Board. <br /> 3. Staff. The County Manager or his designee shall serve as <br />staff for the Commission, shall .organize its meetings and shall <br />provide for such office services if the Manager is of the opinion <br />that it may be appropriate for the Commission to accomplish its <br />tasks. <br /> Adopted this 6th day of April, 1992.
