93 <br /> <br />Water and Sewer District Meeting <br /> <br /> Chairman Carpenter recessed the meeting until the conclusion of the meeting <br />of the Water and Sewer District. <br /> <br /> Chairman Carpenter reconvened the meeting of the Board of County <br />Commissioners. <br /> <br />Zoning Atlas Amendment - Public Hearing - 7:00 <br /> <br /> At 7:02 P.M. Dr. Nancy Randall, Chairman of the Cabarrus County Planning <br />and Zoning Commission, presented the following Petition 92~10 to the Board. <br /> <br />Petition 92-10. IIG Incorporated, owner by option. Between Miami <br />Church Road and N.C. Highway 200 and part of Map/PIN's 5538-63-9709, <br />62-6023, 82-3105, 31-8548, approximately 160 acres. Wish to rezone <br />from ARR to C-3/SU. The Planning and Zoning Commission voted 8-0 to <br />recommend approval of this petition with the condition that a <br />minimum2OO-foot border be maintained between adjoining property and <br />the property requested for rezoning. <br /> <br /> Mr. Gerald A. Newton, Director of Planning, Zoning and Building <br />Inspections, reviewed the proposed rezoning request along with the special uses <br />requested for the property. He noted that the company is currently seeking <br />access to the tract from Highway 200 in order to prevent excessive traffic on <br />Miami Church Road. Mr. Newton reported that the site had been selected due to <br />its accessibility from Charlotte as well as other areas of the county, the <br />availability of water and sewer service to the area, and the seclusion of the <br />property. He further stated that the studio will offer a diversification in <br />employment opportunities, increase tourism, and increase the County's tax base. <br /> <br /> Chairman Carpenter opened the public hearing regarding Petition 92-10 and <br />asked if anyone were present who wished to speak for or against the proposed <br />rezoning. <br /> <br /> Mr. James Scarbrough, attorney representing the petitioner, and Mr. Kelly <br />Tenney, representative of Charlotte Metro Studios Limited, indicated they wished <br />to speak during the public hearing. They were affirmed by the Glerk to the <br />Board. <br /> <br /> Mr. Scarbroughasked that the Board permit an access from Miami Church Road <br />if the petitioner, after a good faith effort, cannot acquire an alternate <br />entrance to the site. <br /> <br /> Mr. Tenney spoke in support of the rezoning from ARR to C-3/SU to allow the <br />development of the studio along with the support services on the property. <br /> <br /> There was no one else present to address the Board, and Chairman Carpenter <br />closed the public hearing. <br /> <br /> Motion was made by Commissioner Payne and seconded by Commissioner Barnhart <br />to approve Petition 92-10 as recommended by the Planning and Zoning Commission. <br /> <br /> Commissioner Hamby amended the motion to include the provision that an <br />alternate access on Miami Church Road will be permitted if an access on Highway <br />200 cannot be secured. The amendment was accepted by Commissioners Payne and <br />Barnhart. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart and <br />unanimously carried, the Board approved Petition 92-10 by IIG Incorporated, owner <br />by option, to rezone approximately 160 acres located between Miami Church Road <br />and N.C. Highway 200 and part of Map/PIN's 5538-63-9709, 62-6023, 82-3105, 31- <br />8548, from ARR to C-3/SU with the provision that an alternate access on Miami <br />Church road will be permitted if access on Highway 200 cannot be secured. <br />Approval of the petition included the condition that a minimum 200-foot border <br />be maintained between adjoining property and the property requested for rezoning <br />as recommended by the Planning and Zoning Commission. The potential uses <br />included in the rezoning request included the following line items: Multi-media <br />production and distribution complex; auto rental; barber and beauty; building <br /> <br /> <br />
