llO <br /> <br /> AMENDMENT TO THE <br />CABARRUS COUNTY PERSONNEL ORDINANCE <br /> <br />Addition to ARTICLE I, Section 2(b) <br /> <br />Employees of the Home Health Agency shall be subject to all Articles <br />except Article II, Sections 1 -4; and Article III, Sections 1 7 <br />and 9. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Vice-Chairman Hamby with <br />Commissioners Barnhart and Payne and Vice-Chairman Hamby voting for, the Board <br />moved to establish the Home Health Agency as a separate department, effective <br />January 1, 1993, reporting to the County Manager, and agreed to establish a Home <br />Health Executive Advisory Committee, beginning January 1, 1993, with the <br />following membership: <br /> Chairman: Director of Cabarrus County Public Health Department <br /> Member: Chairman, Home Health Advisory Board <br /> Member: County Manager's appointee <br /> <br />Bid Award - Residential Solid Waste Collection <br /> <br /> The following bids were received on October 21, 1992 for the residential <br />solid waste collection in Cabarrus County for a period of three years beginning <br />January 1, 1993, and ending January 1, 1996. <br /> <br /> Company <br />Browning-Ferris Industries of South <br /> Atlantic, Inc. <br />Chambers Waste Systems of N. C. <br />Waste Management of Carolinas <br />Container Corporation of Carolina <br />D & L Waste, Inc. <br /> <br />Price Per Home/Solid Waste Collection <br /> (Per Month) <br /> $9.72 <br /> <br />$10.19 <br />$11.99 <br />$14.37' <br />$14. o <br /> <br />*Following Notation on Bid: Our bid based on Landfill Fee of $28.00 per ton. <br />If this is increased, CCC will expect the Board of Commissioners to pass on an <br />increase to reimburse us for our additional landfill expense. <br /> <br /> Mr. George Daly, attorney representing Container Corporation, asked that <br />the Board delay the bid award and enter into negotiations to extend the current <br />residential franchise for another year. According to Mr. Daly, members of the <br />Board in 1988 had indicated that the five-year solid waste franchise would be <br />extended an additional year to allow time for the company to recoup its <br />investment in equipment required for the conversion to the roll-out cart system. <br />Also, he noted that the County's recycling program currently conducted by CCC <br />under a five-year contract is not a profitable operation for CCC. During his <br />presentation, Mr. Daly pointed out that a dispute between CCC and Cabarrus County <br />regarding the landfill tipping fee conversion from tons to yards had recently <br />been resolved. In conclusion, he stated in his opinion the County's Solid Waste <br />Ordinance relative to flow control is unconstitutional and would be subject to <br />litigation. <br /> <br /> Mr. Hartsell asked for documentation relative to the alleged extension of <br />the solid waste franchise as no County record could be located regarding such an <br />extension. No written documentation was presented by Mr. Daly. <br /> <br /> Mr. Brian O'Leary, President of CCC, also objected to the bidding of the <br />residential solid waste collection by the County. He stated a one-year extension <br />of the current franchise was needed in order for that company to recoup the cost <br />of the roll-out carts and other collection equipment purchased for use in <br />Cabarrus County. <br /> <br /> Mr. Lee Spinks, attorney for Browning, Ferris Industries (BFI) of South <br />Atlantic, Inc., stated in his opinion it would be unfair to BFI as the low bidder <br />to delay the award of contact and to rebid the residential solid waste <br />collection. He further stated that all the haulers had agreed to the use of the <br />roll-out carts in 1988 and that he knew of no action that had been taken to amend <br />the current franchise. <br /> <br /> <br />
